Has anyone had an issue with the tailgate rubbing against the bumper and rubbing the paint of the edge of the tailgate.

The tailgate is misaligned and should not be touching the bumper. Your dealer should be able to fix that easily.

That was looked at and they said it was not misaligned. It does not actually touch the bumper. When you open or close it I try to watch it to see if it hits but it does not seem to. So I think something is moving when we are driving and hitting bumps.
Last July I was in an accident with the car and I was pulling a trailer and it Jack Knifed in to the rear passanger side, and ever since them I have been working with the body shop to try and fix it but they are having problems finding the problem. They have replace the clips that hold the bumper thinking that they were not holding, they adjusted the latch on the tailgate because that seemed like it was pulling to one side and that did not help either. So I was wondering if it was something else and other people might have had the issue.

It does not actually touch the bumper.

You said the paint is rubbing off so there has to be contact at some point. Unless you're doing some extreme driving, there should be no contact at all if the alignment is proper. Just my opinion. :)

We lost a big chunk of paint off of the (L) bottom corner of our tailgate and we weren't in an accident etc. it just flaked off. Glad our lease is up in the Spring!!
