Actually, you should never exchange information. Let the police give you the information. If you do, then it can be considered a verbal agreement and it becomes a civil matter. The person at fault will be able to drive away, possibly without even having to face charges. Police won't even give you any paperwork. This is advice I didn't have after someone pulled out in front of me. It was my first time in an accident. I wasn't at fault, but what if my insurance wouldn't accept my claim because their was no paperwork? Just food for thought...

    Dear Mr. Philip Reed,
    Senior Consumer Advice Editor

This accident happened in West Palm Beach, Florida. I was at stopped at a red light behind two other cars. A truck collided with my car rear at approximately 45 M/H pushing front to the other two cars. The rear of my car was totally destroyed. I was in the JFK Hospital for tree days due to back, neck pain and right knee swollen. After that I was in bed at home for two additional weeks.

I hired an injury lawyer when I was in the hospital, and three days later I called him and he told me that the driver at fault had only basic insurance with $10.000. Lawyer explained to me, that there was not enough money for payment of medical bills, damages in my car and the other two cars and no money for a rental car for me. I have also only the basic insurance requested by law. The driver at fault, which hit my car at rear, reported to the police that he was looking at his computer at the moment of the collision, and got a violation and citation for careless Driving (as per the traffic crash report).

I have been without a car going to work by bus and expecting the bills from the hospital.

Now it has been four weeks, I call and email the lawyer that I hired, but he never answer.

What I can do? Thanks in advance for your ideas.

What happens when your wife is leaving work, just pulled out, gets a van 5 to 6 of illegal Hispanics pull over in front of her. They have no license, no insurance, the van was considered a business farm van. The owner was not there or driving. The police did a report told them they were responsible for the damaged and would be sued. H e said the van was not going no where. He left, then my wife noticed another van that the officer said was in front off the road. Then the van just happened to disappeared to that was not going anywhere. He did not write any tickets, even though no Insurance, or no DL/ This is Indianapolis IN. Our Insurance company Esurance wanted to blame us before they had the police report. We had to order it because they could not get it, they were even working out of Wisconsin Office. We paid for the Police report and the Officer automatically put down that my wife said she could not stop even though she just pulled out and left work; the van came up in left lane and cut over in front of her and came to dead stopped. He said she came up behind them and could not stop as she was trying to turn in the left lane. What is wrong with this picture? The Insurance company, The Police officer, The undocumented, uninsured business truck, the unlicensed Driver? or all of the above and how do I fight this.
