No "Get Out of Jail Free" Card for Volkswagen Officials, Senators Urge

The Volkswagen diesel-emissions crisis is drawing the attention of two U.S. senators, who told the U.S. Department of Justice on Monday that Volkswagen officials "should be granted no get out of jail free card."

    This may be a problem that does not have a true fix. VW will need to reprogram the ECM to remove the defeat device so their 2.0 TDI's run clean all the time. However, if the cars don't run the same after the fix a number of owners will add back the old software. I've already seen posts on TDI sites where people state that they will provide the current ECM code with the defeat feature to people who are not happy with the fix. Remember, this defeat feature cannot be detected with normal smog testing.

    Was anyone at GM criminally prosecuted for the ignition switch issue that resulted in deaths?
    How many people died as a result of VW's emissions fix?

    I can see massive punitive financial penalties for both VW and for the gilded suits involved, but jail seems a bit much, given precedent. I am sure some loud senators will use it to distract from real issues, and some comfortably compensated DOJ "workers" (the bright minds that keep us fighting the war on drugs) will lick their chops at a chance to show off their arrogance and accountability-free roles. However, given the state of the incarceration industry, jail seems like a way for American Justice to appear even more like an oxymoron than it did before. Gross waste of resources. Seeing as almost nobody responsible for the recent financial crisis earned more than a slap on the wrist, this is hard to defend.

    Nice move from the departed AG Eric Holder, who now works at Covington and Burling, a law firm that defends banks.

    But yeah, let's prosecute VW for all the lives they have ruined!
