Does anyone have a problem with "lane assist" spontaneously activating for no reason?

From day one, as we drove our new S560, we experienced a frightening and extremely dangerous situation wherein the car would suddenly brake and swerve regardless of speed jolting anyone riding in the car. It was finally determined that this is a malfunction with the lane assist function which activates for no reason. We have been told by Mercedes that merely replacing sensors will not necessarily fix the problem as it doesn't show up on the dashboard with a warning or in two of their computer system checks. Drivers assist was shut off by the dealer and it is still spontaneously activating. We want to return the car or exchange the car because it had a defect from day one. Mercedes says we must go thru the lemon law, but we do not want a to own a new car that has to be torn apart that could result in future issues. DOES ANYONE KNOW OF THIS HAPPENING TO OTHER MERCEDES MODELS? CAN WE LEGALLY REQUIRE MERCEDES TO TAKE THE CAR BACK? Your help is appreciated.

    Go through the Lemon Law process, stuff like this are what it is for.

    Would greatly appreciate if anyone who has had a similar problem with their Mercedes Benz would share it. The Lemon Law works to protect people with a car problem, however, this problem was present from the time we took possession of the car and drove it, which was after we purchased it.

    I teach a couple classes on these systems and assist shops with diagnosing the more difficult failures. If I drove your car how likely is the problem to occur? How many times would it happen in a fifteen minute drive that included multiple traffic conditions such as rural highway and interstate driving?
