Sold car to used car Dealer and now he wants to return it
Hi All,
I sold my used 2000 Honda Accord Coupe to a used car dealership last week. I got a Voice Mail from dealership yesterday evening saying the car has problems and he wants to return the car to me. According to him, MA Lemon Law allows him to cancel the car sale within 7 days (Yesterday was right on the 7th day). I have not had or know any issue with the car before dealer called me yesterday.
I returned his call this morning and asked him to send me paper work of what's wrong with the car and estimated repair cost so I can make a decision of what to do. But he is threating to take this to court. Am I doing the right thing of asking for paper works? Also, does the Lemon Law cover sales to dealership? when I googled the law, I see it mention it covers sales from dealer to private sales or private to private sales. It does not mention private to dealer sales.

Lemon laws have nothing to do with this unless your state has some strange laws.
I would let him take you to court but he's probably bluffing.
As a dealer he should have been able to tell if the car really had problems.
I suppose if he could somehow prove that you KNEW the car had major problems that you
didn't disclose then possibly he could win in court but I doubt it.
I've never heard of a dealer trying to get a private seller to take a car back.
Something just sounds strange here.
Try asking your local consumer protection agency or attorney general's office for advice too.
You might call his bluff and ask for a copy of, or a link to, the law that allows a dealership to cancel the sale.

Thanks guys, I didn't think he has a leg to stand on. When I asked him to provide prove that the car failed State Inspection within 7 days he initial agreed to have it within 7 days. But I then reminded him the Inspection failure prove needs to be within 7 days from date of sale (MA Lemon Aid Law, but now looks only apply to private to private sales) not within 7 days from today's phone call, he said "You are in big trouble" and hang up.
He paid in cash, so the money is already in my bank account.
Auto dealers are regulated pretty heavily in most states. You still may want to report this to the "authorities".
I have the feeling you'll never hear another word out of that store.
I actually got a text message from the guy with a Court Date and saying if I loss I will have to pay his attorney fees. I simply replied back with "I am looking forward to see court's official notification". Will see what comes out of it.
If he got a court date that quickly, he's got more magic available to him than simply twisting the law to suit his needs. In my state, such a case would be heard in the county courthouse. You might call them and see if a case has, in fact, been filed against you. "You're in big trouble" sounds a bit childish to me. If he wanted to scare you with the truth, he'd produce written evidence that he's in the right.
