2000 Honda Civic LX. Why is temp sensor on cold side of thermostat?

having probs with the overflow tank filling up and not returning or partially returning on cool down

    I'd replace the radiator cap for starters.

    Yep did that. Is aftermarket rad. so is hard to find one to seal. Ended up being head gasket. Hydrocarbon test confirmed.....:(
