Again the issues, are same : inadequate to NO insurance.
In the state of CA, NO licenses of ANY kind are required to drive a bicycle. When stopped for an infraction, legally you are not required to even have an ID.
There's a pretty high casualty rate among older motorcycle riders, unfortunately, and when you couple that age group to a clumsy, enormously heavy type of motorcycle, it only gets worse.
I have to say though that "mature" motorcycle drivers do seem fairly cautious---perhaps too much so. But the younger ones with gorilla bars, no helmet and extended forks are really pushing their luck.
When I first got my license, a friend and neighbor taught me to drive Harley's, both a fully rigged (@ the time) and a chopped Harley. The "bug" (Hogs to Sport) never seemed to bite me, even as I had a roommate in college with a Triumph 650. I look back on the experiences with a mixture of gratitude, excitement, (freedom of the road)! As I got older, absolute HORROR crept in, as I fully realized I had dodge HUGE bullets! (aka, no accidents, never put down a motorcycle, hardly wore protective clothing, let alone had or used helmets, etc.)
I think you know the saying: it is not IF you put down a motor cycle, it is WHEN and how many times. (if you are remotely lucky)
If I remember correctly, the Triumph 650 was a 1 year old (1972?)1973 model. It was bought new and delivered in Europe. My roommate toured Europe (1972?)1973 with his sister and her then boyfriend, long since husband.
In the state of CA, NO licenses of ANY kind are required to drive a bicycle. When stopped for an infraction, legally you are not required to even have an ID.
As long as you aren't doing something that requires you to have ID available, i.e. driving a car, there's no legal requirement to carry ID with you at all. There are no state or federally mandated IDs in the US. State IDs, drivers licenses, and passports are all optional. Admittedly, it's difficult to do many everyday tasks without an ID but they aren't legally required. If asked by police for identification it is sufficient to simply state your name (unless, again, you're doing an activity for which you are required to be carrying an ID like driving).
And though I believe we need to guard our privacy I would not advise trying to go off the grid to the extent that you shun having appropriate ID available. The trade-off just isn't worth it. Better to be a needle in a haystack than a needle in plain sight..
He'd be dead. Can you sue people in the afterlife?
Maybe the estate?? We're into one of my least favorite times of year here. The month leading up to the Tour de France (a great event that I enjoy) means that the "lost peleton" shows up on the roads around here. They were out at 5 pm yesterday on a heavily traveled road riding three-wide in the car lane with a bike lane going unused beside them.
YUP !! A lot of bicycle drivers drive with almost a complete disregard!
So do you think when they catch up with this BMW driver, he will claim either the motorbike was being rude and aggressive and "lane splitting" ? That what the motorcycle driver mouthed off at him, put him/her in complete fear of his/her life? Then when the bike got in front (of the car) the motor cycle driver became passive aggressive, creating the accident that did happen.
For whatever reason, it is not clear what was the brand of motorcycle. For all we know, IT also could have been a BMW. The logic would then indicate they deserved one another? ! But then you can infer a number of things by the choice of brand. But evidently, the motor bike driver was willing to pay the price of vigilantism. It makes me wonder what would have been the motorcycle drivers reaction if the BMW driver told him to stop splitting [non-permissible content removed] lanes.
Not a BMW motorcycle gauge cluster or noise. By the gauge shape and sound, I guess a late model 500 series Honda.
Best thing to do is get the plate and car on camera, and put it on youtube with the plate in the title. Then let things run their course.
Still, a BMW driver, it never fails. Fear of life, puhlease. The biker did overstep his bounds, but lets be real. Now let's see what the anarchy preventers will do.
Filtering is legal in CA? I suspect the phone law includes when sitting at a light.
We are being real! So far nothing is/ has being /been done! What makes you think anything will be done? Another take is the BMW driver can say the accident was the result of lane splitting.
No, phone laws are ambiguous and subject to interpretation. More importantly an officer needs to be the witness and stop the perp, aka SOL in the above case?. Truly the foul mouth motorcycle driver was lucky not being more seriously injured or a fatality.
Nothing will be done. I am sure the anarchy preventers there are all about the speed enforcement, too. That's why you get it on video and let the public be the judge. If you actually watched the video and saw the time of impact, you wouldn't blame it on lane splitting. Of course the BMW driver can say it, but BMW drivers already have a huge rep. At a minimum, he should get a leaving the scene of an accident charge, no matter who was at fault. A cop doesn't have to be a witness to that either, video will suffice. What he actually receives is another matter, due to the amusingly named "justice system".
I'd like to see what the California RCW says about using a phone even at a red light. Show me what is subject to interpretation. We know you people down there have rolled over and allowed wacky laws now and then.
Being foul mouthed isn't illegal - more people deserve it. Nobody has a right not to be offended, not even in the PC Republic of Californistan.
..."A cop doesn't have to be a witness to that either, video will suffice"...
Video will not get him the ticket. Secondly, you are parsing what I have said, to misrepresenting it. You have done that consistently enough over many posts, so it is not a stretch to see it is how you roll !
What makes you think I didn't watch the (redirected) video? Again I am NOT blaming it on lane splitting, as you again so misrepresent.
Sure you can google CA laws just like I can, You can also interpret both the laws and interpretations. So get off your duff and do it rather than infer that somehow your bombastic WA state POV indignation is "justice". It (your pov) is just bombastic.
You seem to want to infer that you WA state folks don't make their share of STUPID laws ! Good luck with that.
YUP, being fouled mouth isn't illegal! ANYONE can easily return the signal (to return the message)! So what and why bother! ?
This wasn't in California. This was in Los Angeles. People don't realize there are 3 or 4 very distinct Californias as economically and politically opposite as Manhattan and Alabama. This translates as well into types of cars you will see on the road and driving behaviors associated with them.

YUP! Indeed there are area specific codes, ebbs and flows.
For some strange reason, I have for many years LOVED and still love driving in the LA LA area !! Part of it is "when in Rome do what the Romans do"! Another part might be the entertainment value. Even after more than a generation, it still has a HUGE car culture.
Also, ya gotta love moving along @ 80 to 85 mph and NOBODY cares ! Indeed, one should not be LLC ing @ those speeds! Then of course the folks you are holding back ...may?
I am sure he probably was. LOL! DRAFTING Juan Pablo Montoya wannabe?
I think I saw this on " Modern Marvels"?, but the LA area has a centralized highway management control center for keeping congestion down to first step CHAOS ! Wide scale use of CCTV's, sensors of all types, plus LEO and civilian reporting are all part of the mix.

I saw quite a few upscale vehicles in Palm Springs recently impressing me as to the local wealth. I've been advised by my financial adviser that most of these are rented or leased, not owned or purchased by their drivers. How inconsiderate to lead others to believe otherwise. "Things are not always what they seem to be."
I always liked the one about the Texan telling the Michigander that it took him all day to drive across his ranch.
The punch line was "Yep, had a truck like that one time myself. "
"Nearly a tenth of buyers who financed their vehicles in May received no-interest loans, the highest level since September, said analysts from Edmunds.com" (autonews.com)
On the bright side, all those people will be required by their lender to have insurance, so your chances of recovery when some idiot sideswipes you will be higher.
Smart money might not buy a supposed asset with eye-watering depreciation, but lease it and write-off the expense. Our trickle-up economic policies make it easy.
How inconsiderate of the dope on the street to judge wealth by a car.

I'd take the laws here over those in your weird playground for affluent luckyboomers, sketchy foreign money, and a growing underclass...oh crap, sounds like here - probably because so many Californicators fled north.
Why mention the lane splitting or the foul mouth? Both are irrelevant to the situation. Why offer ridiculous cop-out excuses and justifications for the BMW? You obviously have a problem with the biker, but not the BMWdbag. So what are you blaming it on, then? Pray tell? What did I misrepresent? Puhlease, again. Your hard to decipher words say it all.
You mentioned the foul mouthed tangent in your typically ESL-quality response. Being foul mouthed is irrelevant to the situation.

I have to agree with Fintail on the biker being ran into the ground by the BMW driver. Although the biker was "asking for it," by using foul language to chastise an illegal driver (same as driving illegally; not about their green card).
The biker may have been out of line using that language; who knows though how long or how bad the BMW's driving was prior to the stoplight!
Regardless of all that, the BMW is guilty of Attempted Murder, Hit & Run (a serious offense at least in my mind), and reckless driving. Who cares about the cell phone violation ticket given the more important chargeable offenses listed above!!
I think 6 years in jail to sit side by side with the Boston Bomber obstruction of justice guy would be appropriate.

Another total misreading and misrepresentation! Keep up you pretentious presentations!
The second posting indicates the license plate was video captured. it is looking like the perp will probably not get caught, let alone face the far more serious charges he deserves.
Right, the first video was no where near definitive. So if that was what you had, it would be about as good as squat.
Are you saying the underclass is emigrating to your area? Now, that is TOTALLY irrelevant!

Perhaps instead of writing pointless speeding tickets the LEO's or anarchy preventers could stalk that intersection for black BMW's driving through again.

I think a lot of folks following this board would agree. So I think unless the motorcycle driver can positively ID the perp, the perp might not face the more serious charges, IF he/she is indeed caught.
It does raise the question why there remains no perp description . Evidently the use of the camera product is not giving the motorcycle driver the results that he may have hoped for.
Read the comments - the video shown is cropped, more was captured by the gopro - probably removed to prevent against internet based vigilantism, which is a real risk when the system fails.
Taxpayers as a safety net, just like for lucky aged public sector retirees who live in expensive areas and drive nice cars etc. The insurance had by the biker is also...guess what...irrelevant. I see a pattern here.
Not prosecuting serious crimes, yep, that's a Nobama issue, I just wish we had the fair and ethical justice system that existed under Dubya and WarCriminalCheney, or Daddy Bush, or Ronnie, yup, lulz. It's funny when the bitter try to make things political, another epic fail.
Definitely a hit and run charge is in order, even if some think he may have been fearing for his life because a lone guy on a mild mannered bike swore at him. Some people....
I wouldn't even put him in jail, just implement severe financial penalties.

And they certainly are bitter. The interviewed motorcycle driver came across bitter and not a happy camper. It will be entertaining to see what develops in this motorcycle drivers saga?
The biker should be bitter, well, if the system fails - those wheels can turn pretty slowly, as they don't really have any accountability, and the system in that area isn't known for perfection. His donation page might just spiral out of control and solve problems, at least for now - he's already at 80% of his goal.
The biker raises the a good idea, too: "Yes... I record every single time I hop on my motorcycle. Any smart rider does"
Obviously, that BMW driver needs to be caught and punished. However, in watching the video, I think where the biker really screwed up is that he got in front of the BMW and held him back when the light turned green, to drive home his point. IMO the lane splitting was wrong, legal or not. That was a tight space to squeeze though. Yelling at the driver of the car, regardless of what he was doing, also not cool in my book. It's actually somewhat similar to my story a couple weeks back when I was getting ready to make a turn onto a busy road, when a guy on foot yells at me outside my passenger window. Took me totally by surprise, and startled me.
So, this guy in the BMW is startled, and pissed that someone's getting up in his business. But then the icing on the cake is when the biker moves all the way to the front. That light turns green, and you see a Prius, of all things, get a really good lead on them, and about half way through the intersection before the biker even takes off. Well, that's just going to get the BMW driver even more steamed.
Also, throughout that whole video, that biker never even catches up to the Prius, and is still holding the BMW driver back. That's only going to increase the BMW driver's anger, holding him up like that. I know that's one of the things that annoys me the most as a driver, when someone's in an all-fired hurry to get in front of me, and then slows down.
That BMW driver definitely went too far, but the biker provoked him. Not just by yelling at him (that was more of a whine), but the other things, like holding him back at a green light, etc.
FWIW, I've yelled at people on the cell phone too. But I only do it if they're affecting me directly. For instance, if someone is in front of me, driving way too slow because they're on the phone, I'll pass them (when safe to do so), lay into the horn, and yell at them "GET OFF THE PHONE AND DRIVE!!" Never had anyone come after me, but if someone tried that BMW maneuver, the results would be a bit different when applied to a Ram, versus a motorcycle!
Obviously, running the dude over is NOT the way to go. I do, however, want to point out that, in the news report video at about 1:30, the reporter states the biker said "he kept looking back and tried to get out of the way." Really? The right lane is totally unoccupied leading up to the wreck.

AH yes, a "LEFT" narrative if I ever heard one (pun intended). Especially since the basic speed law is "keep right except to pass" or because it is a city street, unless making a left hand turn. Or was that ones' OTHER left?
No, I don't think that was irrelevant to that situation.
Had the guy on the bike not squeezed between those two cars and sworn at the guy in the BMW, that accident wouldn't have happened.
In this day and age, you just don't do those things especially in L.A.!
I would also agree! Per Andre1969's explanation, the motorcycle driver did @ least three road rage things 1. split the BMW drivers lane as 2. he was dressing him down 3.the motor cycle driver once in front of the BMW driver was probably acting out a passive aggressive scenario. aka, up yours,... I am now in front of you, LLCing no less.
Most folks who drive "defensively" understand from the get go, that in a potential road rage situation, the best is to @ a perp's six. Just that alone, takes a lot of steam off the situation. The perp's normally get tired looking in the rear view mirrors and accelerates away. It looks like the motorcycle driver was baiting/taunting the BMW driver. I think the situation would have de-escalated if the motor cycle driver passed and pulled to the right lane, like one is supposed to. The BIGGEST mistake was being @ the BMW drivers 12 o'clock, while LLCing him !!! I think he was duly shocked when he got side swiped or rear ended, as he didn't think the BMW driver would DARE take him up on it or hit him by accident. That was another... BIG MISTAKE ! It takes two to tango and both sides need now to ante up. That is IF the BMW driver is/can be caught.
I remember being taught in Driver's Ed that if you ride a motorcycle, the safest place to be is in the left part of the lane. There, you're going to be most visible in the rearview mirror of drivers in front of you. If you're on the right side of the lane, drivers behind are more likely to try and pass you, dangerously, in the lane. And the middle part of the lane is more likely to be coated with oil and other droppings from vehicles, so it can be slicker.
Upon watching the video again, it looks like the biker tended to stay to the right side of the left lane. I notice that, as the BMW clips the biker, there is an oncoming car. I wonder if the BMW did actually simply try to pass the guy, partly in the travel lane and partly in that "chicken lane" down the middle, but when he noticed the oncoming car (even though it didn't appear to be in the chicken lane), and swerved back over?
Obviously, running the dude over is NOT the way to go. I do, however, want to point out that, in the news report video at about 1:30, the reporter states the biker said "he kept looking back and tried to get out of the way." Really? The right lane is totally unoccupied leading up to the wreck.
On one hand the BMW could have passed on the right safely and easily it appears. Unlike the Camaro vs. pickup truck driver discussed previously, this biker didn't block two lanes with his slow speed. Still, on the other hand the bike should have moved to the right lane as he was not passing anyone in the left lane; a violation I find most offensive.
Maybe the BMW tried to scare him by getting too close and misjudged his Manuever accidentally knocking him over.
There's a new case in SD of a woman that ran over a Navy man on a motorcycle; killed him. Story goes it was road rage and there was some dispute. Her claim is he kicked her car and tried to run off (that would be hit & Run as well). Excellent point about the system not working resulting in the Navy guy's death if her story is true. Insurance companies and police agencies will sit on their hands and pretend nothing is happening similar to Cadillac with GG's problems if you don't get at least a license plate number, and better yet the driver's information.
So it is very understandable and forgive-able if she ran the guy over and killed him because he tried to escape justice. She was defending her property. That being said, she shouldn't have ran him over if there was an opportunity to just stop him without killing him.
'18 Porsche Macan Turbo, '16 Audi TTS, Wife's '19 VW Tiguan SEL 4-Motion
To me, the real points here : that IF he motorcycle was really practicing "defensive" driving , THEN he had at least four options for de esculation: 1. Not to split lanes 2. Take pic/video of license # and perp and report driving texting violation 3. Get @ the perps 6 4. Pull over to the right after passing /getting in front of the car driver. None of the above options were chosen.
In contrast, I saw another video that made me laugh. A crew of scofflaw motorcycle trickster types were doing wheelies on a local highway @ high speeds. The go Pro's are clicking away. It was showing the crew of tricksters doing their thang and a CHP on a motorbike in hot pursuit. The CHP complied with the tricksters warning to keep his distance. It hit both the news and u tube. Nobody got arrested.or should I be more pc. It is being investigated, so it doesn't happen again!!??
Drove across the pass to the east side today - no real issues, but quite a few LLCs, and trucks off to the elephant races. Took the back roads and got off 90 right after Vantage, and had a relaxing drive where I was sometimes the only car in sight. That's one way to avoid inconsiderate drivers, be the only one on the road

Had the guy on the bike not squeezed between those two cars and sworn at the guy in the BMW, that accident wouldn't have happened.
In this day and age, you just don't do those things especially in L.A.!
