In the state of CA, NO licenses of ANY kind are required to drive a bicycle. When stopped for an infraction, legally you are not required to even have an ID.
I have to say though that "mature" motorcycle drivers do seem fairly cautious---perhaps too much so. But the younger ones with gorilla bars, no helmet and extended forks are really pushing their luck.
I think you know the saying: it is not IF you put down a motor cycle, it is WHEN and how many times. (if you are remotely lucky)
I fully expected to drive up to a crash scene but that didn't happen.
And though I believe we need to guard our privacy I would not advise trying to go off the grid to the extent that you shun having appropriate ID available. The trade-off just isn't worth it. Better to be a needle in a haystack than a needle in plain sight..

So do you think when they catch up with this BMW driver, he will claim either the motorbike was being rude and aggressive and "lane splitting" ? That what the motorcycle driver mouthed off at him, put him/her in complete fear of his/her life? Then when the bike got in front (of the car) the motor cycle driver became passive aggressive, creating the accident that did happen.

And a BMW driver, I am shocked. They are usually so responsible and smart.
Best thing to do is get the plate and car on camera, and put it on youtube with the plate in the title. Then let things run their course.

No, phone laws are ambiguous and subject to interpretation. More importantly an officer needs to be the witness and stop the perp, aka SOL in the above case?. Truly the foul mouth motorcycle driver was lucky not being more seriously injured or a fatality.
I'd like to see what the California RCW says about using a phone even at a red light. Show me what is subject to interpretation. We know you people down there have rolled over and allowed wacky laws now and then.

For some strange reason, I have for many years LOVED and still love driving in the LA LA area !! Part of it is "when in Rome do what the Romans do"! Another part might be the entertainment value.
The ride back was even worse! Nothing like tailgating a semi at 75 MPH!
I think I saw this on " Modern Marvels"?, but the LA area has a centralized highway management control center for keeping congestion down to first step CHAOS ! Wide scale use of CCTV's, sensors of all types, plus LEO and civilian reporting are all part of the mix.

Why mention the lane splitting or the foul mouth? Both are irrelevant to the situation. Why offer ridiculous cop-out excuses and justifications for the BMW? You mentioned the foul mouthed tangent in your typically ESL-quality response. Being foul mouthed is irrelevant to the situation.
The biker may have been out of line using that language; who knows though how long or how bad the BMW's driving was prior to the stoplight!
Regardless of all that, the BMW is guilty of Attempted Murder, Hit & Run (a serious offense at least in my mind), and reckless driving. Who cares about the cell phone violation ticket given the more important chargeable offenses listed above!!
I think 6 years in jail to sit side by side with the Boston Bomber obstruction of justice guy would be appropriate.
The second posting indicates the license plate was video captured. it is looking like the perp will probably not get caught, let alone face the far more serious charges he deserves.
Right, the first video was no where near definitive. So if that was what you had, it would be about as good as squat.

While this is not related to the criminality issue, the second posting's tidbits of the narrative indicated or inferred the biker was way under insured and probably remains so. Again to state the obvious, he was lucky. He could have just as easily been way more seriously injured and at much higher uncovered costs. According to the report this was not his first brush with motorcycle accidents? ! The taxpayers would be the safety net of next resort.
It does raise the question why there remains no perp description . Evidently the use of the camera product is not giving the motorcycle driver the results that he may have hoped for.
Taxpayers as a safety net, just like for lucky aged public sector retirees who live in expensive areas and drive nice cars etc. The insurance had by the biker is also...guess what...irrelevant. I see a pattern here.
Not prosecuting serious crimes, yep, that's a Nobama issue, I just wish we had the fair and ethical justice system that existed under Dubya and WarCriminalCheney, or Daddy Bush, or Ronnie, yup, lulz. It's funny when the bitter try to make things political, another epic fail.

So, this guy in the BMW is startled, and pissed that someone's getting up in his business. But then the icing on the cake is when the biker moves all the way to the front. That light turns green, and you see a Prius, of all things, get a really good lead on them, and about half way through the intersection before the biker even takes off. Well, that's just going to get the BMW driver even more steamed.
Also, throughout that whole video, that biker never even catches up to the Prius, and is still holding the BMW driver back. That's only going to increase the BMW driver's anger, holding him up like that. I know that's one of the things that annoys me the most as a driver, when someone's in an all-fired hurry to get in front of me, and then slows down.
That BMW driver definitely went too far, but the biker provoked him. Not just by yelling at him (that was more of a whine), but the other things, like holding him back at a green light, etc.
FWIW, I've yelled at people on the cell phone too. But I only do it if they're affecting me directly. For instance, if someone is in front of me, driving way too slow because they're on the phone, I'll pass them (when safe to do so), lay into the horn, and yell at them "GET OFF THE PHONE AND DRIVE!!" Never had anyone come after me, but if someone tried that BMW maneuver, the results would be a bit different when applied to a Ram, versus a motorcycle!
Had the guy on the bike not squeezed between those two cars and sworn at the guy in the BMW, that accident wouldn't have happened.
In this day and age, you just don't do those things especially in L.A.!

Most folks who drive "defensively" understand from the get go, that in a potential road rage situation, the best is to @ a perp's six. Just that alone, takes a lot of steam off the situation. The perp's normally get tired looking in the rear view mirrors and accelerates away. It looks like the motorcycle driver was baiting/taunting the BMW driver. I think the situation would have de-escalated if the motor cycle driver passed and pulled to the right lane, like one is supposed to. The BIGGEST mistake was being @ the BMW drivers 12 o'clock, while LLCing him !!! I think he was duly shocked when he got side swiped or rear ended, as he didn't think the BMW driver would DARE take him up on it or hit him by accident. That was another... BIG MISTAKE ! It takes two to tango and both sides need now to ante up. That is IF the BMW driver is/can be caught.
Upon watching the video again, it looks like the biker tended to stay to the right side of the left lane. I notice that, as the BMW clips the biker, there is an oncoming car. I wonder if the BMW did actually simply try to pass the guy, partly in the travel lane and partly in that "chicken lane" down the middle, but when he noticed the oncoming car (even though it didn't appear to be in the chicken lane), and swerved back over?
Maybe the BMW tried to scare him by getting too close and misjudged his Manuever accidentally knocking him over.
There's a new case in SD of a woman that ran over a Navy man on a motorcycle; killed him. Story goes it was road rage and there was some dispute. Her claim is he kicked her car and tried to run off (that would be hit & Run as well). Excellent point about the system not working resulting in the Navy guy's death if her story is true. Insurance companies and police agencies will sit on their hands and pretend nothing is happening similar to Cadillac with GG's problems if you don't get at least a license plate number, and better yet the driver's information.
So it is very understandable and forgive-able if she ran the guy over and killed him because he tried to escape justice. She was defending her property. That being said, she shouldn't have ran him over if there was an opportunity to just stop him without killing him.

In contrast, I saw another video that made me laugh. A crew of scofflaw motorcycle trickster types were doing wheelies on a local highway @ high speeds. The go Pro's are clicking away. It was showing the crew of tricksters doing their thang and a CHP on a motorbike in hot pursuit. The CHP complied with the tricksters warning to keep his distance. It hit both the news and u tube. Nobody got arrested.or should I be more pc. It is being investigated, so it doesn't happen again!!??
