Just read what happened to you, and your family. Please have your daughter, and yourself checked out, just to be on the safe side. Second, sorry to hear about the car, but think of it this way: The car took that type of hit and was still driveable. Thank goodness you were in the Sube. I guess that the crash test ratings for the Forester are correct. Feel better and good luck. Mark
Gee...that sucks!!!! I'm glad that no one in your family was hurt worse.
Paisan- I'm going to have to disagree with you about reselling repaired vehicles as soon as possible. I kept my 92 Jeep for another six/seven years after the following:
a. Flipping over into a snow bank (roof, hood, passenger door and cargo box frame bent)
b. Backing into a pole (rear hatch replaced)
c. T-boning a car that tried to pull out from a side street (quarter panel, front end and hood replaced)
The Jeep handled all the above with aplomb. It drove problem free until the day I sold it. And I sold it for Edmund's estimated dealer retail price! Of course it did have the odd rattle but then all Jeeps are prone to squeaks and rattles so it’s hard to say if it had any more. :-)
I'm so sorry to hear about the crash. I second everything that was said here. If you run into problems (parts, etc.) call us here at 1-800-SUBARU3. Let the Representative know that you are a friend of mine and I'm expecting your call. We'll get you some help pronto!
Let us know what the doctor says about your daughter!
You know, I have to say it's really cool to see folks here published. Reading Lucien's article in the SCOA newsletter was great, and now Gary made Drive. Sweet.
I'm so sorry to hear about your daughter and your Forester. Man, an accident while on vacation.. that really stinks. I hope your daughter makes a full recovery.
I would like to know if you all would like to have a weekly Subaru Crew Chat where you could talk to each other in "real time". I don't know how many of you have ever been to a chat room, but it is real fun and a great way to get to know your friends even better.
The chat rooms could have an Edmunds.com moderator or maybe one or two of your members could volunteer to host it. Let me know if you would be interested...post me a message about what a good day and time would be for you guys and I'll make the arrangements!
Thanks, Dana S. Livingston Chat Manager Town Hall Edmunds.com
With regards to your daughter, it is extremely important that you get her to a chriopracter as soon as possible.
About 6 years ago, I was rear-ended in my 89' Corsica by a car doing about 80 kmh (I was at a standstill). The hit was so hard that the front seats were fully reclined (ie. pressed against the back seats) after the hit. They never worked the same again.
However, more to the point... I swear my back has never been the same since. I never went to a chiropracter after the accident, and I regret it seriously. Now when I sit a desk for long periods of times, my back hurts.
Kate- Condolencences. I am not familiar with the laws in that state, but in MD and TX the driver who does the rear ending is liable for the entire wreck. That would make a "setup" in this case unlikely. However, you can forget about the other guy's insurance. I was in an accident in TX under similar circumstances (demographic and otherwise-including cop's indifference...actually, he was downright surly with me). The other guy bought a month's worth of insurance just to get the card, then let it lapse. He had "proof" of insurance at the scene, but turned out to be uninsured. This was the second uninsured driver to hit me that year, so State Farm dropped me (which they can do in TX but not MD because of deregulation there- looking forward to Bush yet?) and sent me packing for a high-rate insurance company. I was 23 at the time and poor as dirt. I will NEVER as long as I live go back to State Farm. The car was totalled, the other driver was calling me and threatening my life, and State Farm made a bad time much worse. Also, it is important to take your daughter in. You may end up filing for uninsured motorist under your policy, but if by some miracle the guy actually has insurance, her bills will be covered.
I lost out on that 325is. Plus Q and I figured a four door would be a more practical daily driver. I am keeping my options open at this point, but an '86 535i is about the same size as a '99 Legacy sedan. We drove a 535is on Sunday that was beat. No "Ultimate Driving Experience" there. Last night's test drive was night and day- perfect interior, and gobs of power and torque in a well-maintained vehicle. Amusingly, the engine reminded me of a Phase I on steroids-- same pokiness at low revs, but get it past 3000 rpm and...well, with 2 more cylinders and 35 more horses, let's just say it was very easy to get felonious without even noticing! The seller is quite proud of it, and that is reflected in his price-about $600 over reasonable market value. I am having the car inspected tomorrow and may make an offer at that time, if it checks out.
Sure! Especially if we can have "expert" guests such as Patti on a regular basis. I suggest that we try to pick a time that suits the folks we would like to attract.
Dana: sounds like quite an idea. At some times during the day we're so active it's like a virtual chat anyway.
The key question is when? Maybe Bonnie has tools to figure out what time of day and day of the week are busiest with the current software (doubtful?).
Your humble Crew Chiefs (Mike Smith and myself) could host a session, though I wouldn't object to any other regulars doing the same.
We have to account for different time zones. Early AM here on the east coast is way too early for our west coast collegues, so maybe east coast PM would work best. Maybe 3pm here, noon there?
Loosh: good point, in most states if you're hit from behind it can't be your fault. Just keep good records and those photos, take notes even.
On an engine that old, make sure they check the compression. You don't even want to get into it if the piston rings are shot. Though it sounds like that first one was more likely to have that problem.
Thank you all very much for support and sympathy expressed.
Just a small clarification: I might have come across as someone more concerned with the car than with a child, but this is only because I did not want to sound as yet another "lawsuit-happy" citizen who is eager to claim any injuries, just to sue someone. After living in California for past 10 years, I developed a great distaste for such people, and did not want to even remotely appear similar to them.
I'm taking my daughter to a doctor today. She says she feels better but intermittent headaches and sore skull are still present. Good thing, we had a headrest mounted on the back seat! I'm afraid even to think of what could've happened to her neck, if she was riding w/o the headrest.
Not much update otherwise. My insurance (State Farm) could have been a bit more proactive. So far, I was the one finding information for them, not vice versa. I located and contacted the other guy's insurance in AZ, and thank God, his policy was still valid (it was bought for 1 mo indeed, but only 2 days before the accident). They said, however, that they could not contact him because he left wrong (non-existing) phone and address on file with them. Now they have to wait for police report, to confirm my story. Needless to say, that "responsible driver" never reported the accident to his insurance.
Anyway, I filed my reports in writing and claims with both insurances. Today the photos should be developed, to complement my story.
I found out the name of the supervisor of the cops on the scene, and want to complain about their behavior to him.
Will try to follow juice's plan and buy parts from Darlene, but will need to check with body shop, if they'd accept such parts. They probably make a hefty profit on parts, so that may not fly with them, but I'll check it out.
Having an old trusty Loyale around helps a lot, at least I don't have to use rental cars which I usually hate. Forester is sort of driveable, but with the tailgate hanging on a duct tape, so I'm not taking chances with it.
Ouch! Sorry to hear about your accident. I hope everything turns out OK with your daughter, and best of luck resolving things with the insurance companies. It's not easy dealing with that baloney, and I sympathize with you.
I don't think anyone thought you cared more about the car. It was merely a case of a few of having gone through this before, and knowing that medical records are key to getting the settlement you deserve. So no worries, m'kay?
I just wanted to add my condolences. Of course, the Forester can be repaired or replaced but not you or your daughter so thanks be that no one was seriously injured! Everyone on this site has given you excellant advice and help. I also wanted to second what lucien2 said. I certainly didn't feel that you cared more about your car than your daughter. I also agree w/you about litigation happy people and your distaste for that. I don't think that anyone here would consider you a part of "L"-happy group, to be sure!
Anyhow, good luck and thanks for sharing your story. It certainly reminds me that it could happen to anyone of us, at any time!
So glad to hear you like the idea of a weekly chat...if it draws enough people we can maybe even extend it to a daily hour long one. Great that we have some volunteer hosts (the "humble crew chiefs" :).
Just throw out some times (yes, taking into consideration the East, Central and West Coasters)...and once you come to a consensus, I'll set it up for you. If you want to email me, feel free: dlivingston@edmunds.com.
5pm EST is probably a little too early for those of us on the West coast. I know that Edmunds.com's previous chats have been around 6-7pm PST/9-10pm EST. Something around that time slot would probably be ideal for most I think.

I'm in, as I'm able... how about varying the times from week to week, or month to month... give everybody a chance that way... not all at once, but no system would be perfect. My schedule is already goofy...might as well throw another variable into the mix!
and... (drum roll) SNOW!!! A couple inches minimum tonight! And me with a fresh set of Toyo Observes! (Went studless... finally) Final decision was made on basis of a couple guys at work who swear by them (as opposed to *at* them), and the tire guy who noted that studs wear out a lot quicker than the rest of the tire.... so far so good - they stick pretty well, quieter than studs by a long shot, and the responsible citizen in me isn't chewing up the road. Thanks to all for your comments.
I can be very flexible about this. In case I need information, I'll have someone (my son) lug home some reference material for me if I know in advance. I think it would be a lot of fun.
Don't worry - nothing is for free! There is always some new gadget for his bass guitar that Mom jumps right in and buys. The lure of an expensive amp has him biting at the bit to help me these days!
If you let the band practice at your house .. now that's something.
In my "youtz" my band practiced in my parents house. A gazillion watts of amps, keyboards, drums, and a PA. One of our neighbors actually moved around that time. I don't know if "Lowthar and the Hand People" (the band) was the reason. Probably.
How do you guys feel about Thursdays at 9-10pmET/6-7pmPT? We could try that and see if alot of you could make it, then if you wanted to change the chats to a different time we could do that. Let me know what you think!
Also: I can keep Chat Transcripts of the chat in case you miss one...so you can request those for a missed chat or if you want a weekly one.
If you would like a reminder each week ONLY of this chat, you could certainly request that as well.
I'll see about getting an email set up strictly for correspondence between you guys and myself for these sorts of things...otherwise feel free to write me at dlivingston@edmunds.com!
Let me know what you think of the time slot! (we have Tuesdays for our Editorial and Wednesdays for Manufacturers and Partners).
Sounds good. Might even work for me when I work at home. 6-7pm PT Thursday is about Friday lunchtime here in Eastern Australia. Maybe that's the break I need.
Just so you all know. I am very willing, I just have to get an "approval". I don't think it will be a problem. Just understand that I might have to defer some questions (that is what I explained to my boss) if it is something we are not prepared to "publicly" discuss. If such issues come up, I'll have to work those in a more one-to-one forum. Is that agreeable?

Thankfully his insurance is valid; it's their problem to find him. Hopefully they'll contact the DMV and void his registration.
I agree that you should not drive the Forester until it's fixed.

Pardon us. We US residents often forget this is a world wide web, after all.
As for the litigation-happy, a while ago a garage arm came down on my head. I was in my Miata - a sign from above to stick with Soobs? Your call...
It didn't injure me, I was just a bit shocked. The antennae broke, though.
The insurance guy was pleasant and paid for the antennae, but you would simply not BELIEVE how many people thought I should sue. Nearly everyone!
Why? They were polite, pleasant, called several times to make sure I was OK, and paid promptly for the damage. So why sue?
Peeves me, also.
