I ended up paying $399/month for 39/12k with nothing down the $399 includes the tax and tire and rim protection which is $15 a month of that payment. So it basically was $352/month before taxes.

It depends ... generally, the $2999 is considered "cap cost reduction" or down payment .. all of which is used to lower the monthly payment (about $83/mo on a 36 month lease).
There are other up front costs as well ... first payment, acquisition fee, tags or license, dealer fees.

Your dealer should be able to provide a complete breakdown of how the $2999 is applied - cap cost reduction, 1st payment, acquisition fee, etc. Some of these you can roll into the lease, others must be paid up front.

48 month lease is not competitive.
39 month numbers are .00003 and 50% for 39/12.
The best way to address the negative equity is to find a car you can lease for a low cap cost relative to MSRP. You can get an Accord for under invoice, for example.
Every $1000 of negative equity will add about $28/mo on a 36 month lease.
I would recommend you check the "real World Trade in Values" discussion to see exactly how muh negative equity you have.
Thank you! I am a little ignorant toward the leasing; what exactly do you mean low cap cost toward the MSRP? I don't mind a higher payment to rid myself of this trap im in (within reason! Lol). I maintain about a 10k negative - As I pay my loan down my value goes down more. Can't even catch up.

The best way to get a low lease payment is to find a car with a high residual but a low selling price.

Go to Legend Nissan in Syosset (I saw Joel) I had great success there. I don't know what the payment would be for that set up though its different then what I have.

available for retail purchases is the key phrase - that excludes leasing, in my opinion.
