I had stopped for the light. When it turned green, I waited a beat, and then proceeded through the intersection. Got almost half way through when the kid driving the Chevy nailed my rear tire. It had stopped raining about 5 minutes earlier (really just a sprinkle) - I think the oil on the road was slicked up just enough to help spin me a good 110 to 120 degrees, which might have saved a bit of damage.
All I can figure on the repair is that the collision center is soaking the insurance company. Debatable on whether it was a total - the repair bill was ~$5,000. The '09 van has about 165,000 miles on it.
Driver was uninsured and there were two witnesses who saw him run the light. Insurance company turned it over to collections and they'll reimburse my $500 deductible when they collect from him. (lol, I know, collecting $5k from a 16 year old, good luck with that). I did okay though, since my uninsured coverage paid me $500 for my pain and suffering when I reported that my neck was sore. If the van drives like a crab, then it'll be another story.
So how does a 16 yo kid who can't afford insurance get to drive a late model Malibu? (That is what the other car was, right?)
We're pretty sure it wasn't his car. The "legal" driver was an 18 year old girl/woman riding shotgun. The car probably belongs to her, or her folks. I say legal because the 16 year old had a learner's permit and it was legal for him to be driving because she was licensed. I can't make out the logo on the rear (note the other road rash on their car):
Hmmmmm, interesting. Probably a moot point since you've been made whole by your insurance but can't help but wonder if the legal owner of the vehicle might be the one on the hook for all this.
If he had taken the car with permission then the owner of the car's insurance should be on the hook. If he was driving without permission (which seems unlikely if the owner's daughter was in the car with him), then the owner of the cars insurance would not be responsible...that is all IMHO and the way it goes on Judge Judy.
I didn't think I would have any affects from our rear ender on August 16th, but now I have a very stiff neck. I use rubbing liniment and one of those bean bag microwaye heating pads and it is slowly getting better...but, it is definitely not the same. Hope you don't have any long lasting affects.

I did see someone's karma catch up with them yesterday. Traffic in 3 full lanes backed up for miles going into Pigeon Forge resort. Guy, probably a local tired of all the touista blocking the roads, was driving the nice, paved breakdown lane probably hoping to make it to the next plaza. Police car sitting on side drive talking to someone in a Ford. Cop pulls forward. Breakdown driver motions for cop to pull out in front of him--instead cop steps out of car and waves black Town Car to a stop to talk to him. Yes!
Love it when that happens, but it doesn't happen enough.
My plan is to put unmarked cars on the road...with cameras. If these traffic officers could nail even 5 drivers a day with $500 fines for doing stupid stuff these cars could become a good source of revenue, and may help make the roads safer.

Some insurance checks are marked "Endorsement of this check constitutes a waiver of any and all claims for XYZ." When I was in private practice I was handling a personal injury/property damage claim and the adjuster offered to go ahead and settle the PD claim while we were still hashing out the PI damages We agreed on a PD number and he sent a check; in small print it stated that endorsement constituted a waiver of ALL claims. Needless to say I told the adjuster "Nice try- now send me a check without the waiver language."

I doubt that waiver language in the manner presented is even remotely robust enough to hold up in court. You cannot "sign away" your rights based merely on what a form says. I would just cross it out and then sign it or do what you did. I mean, think of what this is saying: "You paid for my fender so the broken arm is now my problem".

It's all speculation but that scenario about the car ownership is our guess. And I'm not convinced he slid any, just think he was yakking or maybe they were all texting. He saw the freeway entrance and was heading home. One other saving grace was that he wasn't going all that fast.
When I was discussing the injury payment with the claims guy, I told him I had not followed through with a doc visit and was okay with signing a waiver. He said that wouldn't be necessary. Turns out the waiver language was on the check. The medical claims person had also contacted me and encouraged me to go to my doc or the ER if I felt that I needed to at any time and they'd pick up the bill. I'm sure all that's on tape.
We have "platinum" health insurance so that's one reason I'm okay with not pursuing anything further. And a little stiffness is way more tolerable than having to get lawyers involved with this - talk about a huge pain in my neck. If the pain indeed is a result of the accident, like @driver100 said, it'll probably go away in time. Who knows, I just got a new glasses Rx a month ago too, so maybe that's related. It's nothing debilitating at least.
That reminds me, I need to send a couple of thank you notes to the witnesses. Not everyone is willing to hang around for half an hour until the traffic investigation cop shows up so that they can give a statement.

I was talking to Son #1 at a social event last night and he tells me his wife hit a deer and ran completely over it. She is OK but his '13 Infinity G37 has some bruises. The car is drivable but he isn't sure how to even guess the extent of the work to fix it. Even the right front inner fender liner was just about knocked off.
She was coming off the PA pike ramp about to get onto a 4 lane road and the thing jumps right out of a hiding spot and into the right front of the car. She wasn't going very fast (maybe 30 MPH) but said she still had no time to react and was very lucky that the car behind her didn't nail her. My Son has to get an estimate but he has the rental already, a 2016 Buick Enclave. He likes the way it drives and would not mind getting one but it won't carry all the hockey stuff for 2 of his sons. So, he knows he can't get rid of the '16 Kia van he bought this past Spring.

Mr. Brady came through - here's the crash scene. Still waiting on getting the van back so I can get an "after" photo. The Chevy was going southwest and he's in the same driving lane he was in when he tagged me. I was headed westward, ~90° to the right in the pic.
That is a little more than a buffer can handle but not too bad. Compared to the total of the van DIL#2 was driving that is not bad at all.
If nothing else, the kid should be given credit for hitting only one panel at least I don't see any other damage. Can't imagine not needing a new real axle and maybe even some more of that stuff.

FWIW, Son #2 and his wife were out looking locally for replacements yesterday. Mrs. j and I were watching their 2 brats our 2 grandchildren. Nothing to report so far.

Regarding Fast and Loud....they made no pretense about what kid of show they intended to be....over the top as much as they could. The good part of that show, they also had episodes showing Rawlings losing money on cars and going through all the things that DID go wrong with a build. Some of it was staged, and they made no bones about letting you know it was staged.
Sorry to hear Kaufman left. He's a really smart guy. But, there were some builds where it was clear there was lots of tension between him and Rawlings. Rawlings must be tough to work for as there has been a lot of turnover in his shop.

So, the CTS is still awaiting a part that's backordered. As such, they don't want me to drive it as it is a safety item. And, once they get it in, it's supposed to take 2 days of labor to install. I promise to stay calm. But, they called and wanted to know if I'd be interested in driving a CT6 until the part comes in.

As much grief as Cadillac has caused me, I like their current vehicles. The CT6 is VERY nice. White with saddle interior. The GPS/control screen is high resolution, and is as big as the first TV I ever bought (j/k....but not much).
Steering is a little disconnected, but accurate. Not as much understeer as I expected and weighted almost perfectly.
It's a BIG car, which makes its handling all that more remarkable. Lots of work was put into the suspension, it's obvious.
This one is the 3.6L. Sounds expensive. Fast for this type of vehicle. I still like the torque in my CTS 4 cyl turbo.
Seats are quite comfortable.
Braking is "spot on"...not too hard, not too soft, great pedal feel.
Very high quality materials throughout. Soft and supple leather, carbon fiber trim, stitched dash and doors. Auto Park feature. Radar cruise. Stereo is excellent. HUGE sunroof.
Feels like the proverbial vault from the door closing to the feel of all the controls in the cabin.
Can't think of anything the car is lacking. Not sure how much one of them costs (no sticker on it). But, it has to be in the $60K-$70K range.
If Cadillac can ever get their act together on getting parts to repair their cars, they may actually start to do well.

Some years back I would have agreed with you. But for me, their shtick (esp. Clarkson's) got old in a hurry the last few years, and it seemed very forced. I stopped enjoying Top Gear around 2012 or so.
Kind of like Toyota. They have gone from being a fairly interesting to being inoffensive with maybe a dash of faux edgy. Less upkeep means higher margins, and no worries of offending the growing ranks of easily triggered snowflakes out there

Yeah, they had the body work done fast; a lot of the delay was waiting for a new axle and some other suspension parts. At the crash scene I assumed I'd be driving it home, until I looked at the rear wheel. The top was bent in to the fender liner.
I'd love that, I want phone distraction patrols and crosswalk stings. Crosswalk issues are huge where I live, as the downtown core has a good amount of foot traffic, and there's a distracted entitled local population who thinks they can (and often do) get away with anything. First infraction - $500. Second, add a zero. Third, well, you don't want to know And if one is a 2%er, they still have to pay.
If the hypocritical old eco-weenies want to get people out of cars (of course, they won't give up their own cars, but everyone else should), they need to aid the well being of pedestrians. Their dumbo "vision zero" garbage doesn't matter, something with teeth is needed. Maybe question some of the bloated bennie offerings to fund it until it becomes self-sufficient, as I suspect the local driving talent will be slow to adapt.

There is a treasure trove of old game shows on Youtube - The Price is Right is especially well represented. I watched a couple with family over the holiday weekend, fun to smirk at the prizes and fashion style of the contestants. Some of the cars are hilarious, but there are random gems. Well, I knew it wouldn't be long before the technology in my new BMW 740i got the best of me!
This morning, I'm driving on I-95 South from Boca Raton (Palm Beach County) and all of a sudden, a traffic message replaces my odometer and fuel economy gauges at the bottom of my main instrument cluster below the speedometer and tachometer stating, in bright yellow lettering and black background, "...objects in road ahead, caution!" Then, on my iDrive main screen it repeats the message and asks me to acknowledge that I've read the traffic alert message, yes or no? I click "yes" and make an assumption (my first mistake was assuming something logical would ensue) that the caution alert message would disappear. Well, I was wrong (should have known)! I try clearing the alert using my "clearing" button at the end of the directional signal stalk on the steering wheel, and it does clear the message - for 7 seconds - and then it reappears. So I cannot clear the traffic message for longer than 7 seconds. I did notice trash and remnants of a possible earlier accident on the right lane, but I had passed that juncture 10 miles ago.
So I call the BMW dealer and they told me to bring the car in since the car was less than 2 weeks old. Since my driver's side windshield wiper was "chattering" in moderate rain, I thought this would be a good time to kill two birds with one stone. So I make the 30 mile trip out to Pembroke Pines and I wait for about an hour for my advisor to "buzz" me on the pager I was given when I first arrived in service to alert me when the service advisor was ready to see me. We go out to the car and of course the traffic message had disappeared. I swear to the advisor that I am sane and have all my mental faculties - "...Ms. Service Advisor, the traffic alert message could not be "cleared"! It was there for almost an hour and even the valet who took my car and keys saw the error message!" I am looked at like I was crazy, of course, but I catch sight of the valet guy and he verifies my story about the traffic warning message. Thank goodness for small miracles - at least the next time I come in complaining about something, the advisors won't roll their eyes as I walk by - whew!!!
The shop foreman is now summoned. I relate my experience with the traffic alert message - and he responds something along the line of, "...oh that's nothing, there are dozens of different alerts that will come up on that screen in the instrument cluster to warn you of accidents, heavy traffic, debris on the road ahead, construction, etc., to name a few..." he states. He adds that I shouldn't worry about not being able to clear the warning - it will clear itself when the car's computer goes to sleep! It seems that the engine has to be shut down and the car locked and I have to be at least 20 feet away from the car before unlocking it and starting it up again. The message will be cleared. I asked him if this happens all the time - he responded that he has had some complaints from customers about the issue but that I shouldn't worry about it. If it happens again, they will bring the car in for a more in-depth investigation. You would think that what the foreman said would relieve my apprehensions about BMW computers and messages. Well it didn't! The reason I originally stopped buying BMW's back in 2008 was for this exact same reason - messages that would not or could not be erased or stopped. Remember, BMW built me another car in 2008 and the same thing happened in the replacement car - no one could figure it out - they just scratched their heads.
Well, here's hoping I am not bombarded with traffic messages that cannot be cleared. I am not a fan of driving 60 miles round-trip to the service department to have them take the technical pulse of my car. I have enough problems with my doctors taking my own pulse!

I am too lazy to look back...what did they give you for it and what is KBB on it? I think they told me insurance companies opt for a settlement...if damage is 60% of replacement. Since I don't know KBB, it would be interesting to know current value....your old one would probably be worth more as parts considering the labor that has gone into it.

I am kind of enjoying the simplicity of the C 250. No warning bells, no voices telling you to recalibrate, no ON/OFF button, no fancy digital messages.....just get in car, press button, put in gear and drive....and i didn't need lessons from a technological Genius either.

That is a little more than a buffer can handle but not too bad. Compared to the total of the van DIL#2 was driving that is not bad at all.
If nothing else, the kid should be given credit for hitting only one panel at least I don't see any other damage. Can't imagine not needing a new real axle and maybe even some more of that stuff. jmonroe

I am too lazy to look back...what did they give you for it and what is KBB on it? I think they told me insurance companies opt for a settlement...if damage is 60% of replacement. Since I don't know KBB, it would be interesting to know current value....your old one would probably be worth more as parts considering the labor that has gone into it.

That really doesn't make much sense.....sounds like they could have given you $2500 and then sold it for parts. I should get a job with them....get a percentage of all I can save them.
KBB is Kelly Blue Book Value.....it seems to be the prices the dealers use, though their numbers were lower KBB than the numbers I found. I used excellent top condition though, which it was, they probably quote average prices.
Last I really checked, years ago, there were two KBB books, one for consumers and one for dealers. And I've heard that they pad the retail numbers to account for all that "dealer reconditioning" every used car goes through.

But I will tell you that my service advisor is the same one I had when I bought cars there in the 2004-2008 time period and vividly remembers the 2008 535i issues I had. There is general agreement that technology may have gone too far on these cars. There is a lot of redundancy in these systems. Additionally, is it really necessary to have a "display" key that lights up and as you scroll through the data output, it tells you if your windows are closed, if the doors are locked, if the interior motion detector and car motion detectors are on or off from up to 1000 feet from the car? Is it necessary to have these road alerts flashed on your data screens? There is so much technology in this car it actually blows my mind - and I consider myself pretty savvy when it comes to computer technology. It just seems that the more trinkets and tech feedback the car manufacturers put in these vehicles, the more these millennials want. Go figure!

It didn't need a thing, except the 1 year oil change. I don't think the listed price is unreasonable. They will probably sell it for closer to $14000. They have a large operation and salaries to pay etc. If I sold it privately for about $12500 someone could have had a great little car for an excellent price...but, whose got the time and patience?
Don't focus on what happened to your trade. Sometimes the dealer makes out, sometimes they get burned. But as long as you are happy with the net overall deal, I'd say just look forward. Besides, you'll likely never know the specifics of what they netted off the trade or if it ended up at auction. Enjoy the new ride!

You can deactivate most of those systems if you don't want to use them. I've had more than one customer who initially wanted all the bells and whistles and later came in and wanted them dialed back(or shut off altogether). In any case, the warning you received was almost certainly generated by the ARTTI network- and that may be the issue rather than the car. As for display key, you should have been given two conventional keys as well. Just stick the display key in a drawer and forget about it until you sell the car. I drive almost every G12 in our inventory a couple of times per month and this 59 year old finds them to be pretty easy to master after the initial steep learning curve. That said, I probably wouldn't want one for a daily driver until I start pushing 80(95 for an F10).

My calculator says that is a little over a 38% profit without the $599 doc fee. When the doc fee is included the profit is almost 44%.
If they discount the car to $14,000 like @driver100 thinks it will sell for, the total profit is now only a mere 30%.
Nice work if you can get it and in South Florida they get it. More proof that the real money is in used cars not new ones.
This is also proof that the dealership could have afforded giving @driver100 another 200 bucks for his Passat.

I have to agree with Berri on this one. We traded in a car that suited our purposes for 4 years...it cost about $12k in depreciation or $3000 a year (depreciation). We couldn't have afforded a new Mercedes in 2012, but, finances are better now so we can pay the extra $14000 that the Mercedes cost. We are getting a much better car, and it is one year newer.
Since we do so few miles a year, tops will be about 5000 if we start flying to Florida each year, buying a CPO model with 12k miles on it was the way to go.
We are very happy, and if the dealer can make a nice profit good for them. I sure wouldn't have wanted to do the CL thing.
BTW....what would a fair profit be? Don't forget to include overhead and calculate what they might sell the Passat for.
And, I feel better negotiating for that extra $200, or maybe I would feel ripped off!

I didn't think I would have any affects from our rear ender on August 16th, but now I have a very stiff neck. I use rubbing liniment and one of those bean bag microwaye heating pads and it is slowly getting better...but, it is definitely not the same. Hope you don't have any long lasting affects.

My plan is to put unmarked cars on the road...with cameras. If these traffic officers could nail even 5 drivers a day with $500 fines for doing stupid stuff these cars could become a good source of revenue, and may help make the roads safer.

When I was discussing the injury payment with the claims guy, I told him I had not followed through with a doc visit and was okay with signing a waiver. He said that wouldn't be necessary. Turns out the waiver language was on the check. The medical claims person had also contacted me and encouraged me to go to my doc or the ER if I felt that I needed to at any time and they'd pick up the bill. I'm sure all that's on tape.
We have "platinum" health insurance so that's one reason I'm okay with not pursuing anything further. And a little stiffness is way more tolerable than having to get lawyers involved with this - talk about a huge pain in my neck. If the pain indeed is a result of the accident, like @driver100 said, it'll probably go away in time. Who knows, I just got a new glasses Rx a month ago too, so maybe that's related. It's nothing debilitating at least.
That reminds me, I need to send a couple of thank you notes to the witnesses. Not everyone is willing to hang around for half an hour until the traffic investigation cop shows up so that they can give a statement.

Regarding Fast and Loud....they made no pretense about what kid of show they intended to be....over the top as much as they could. The good part of that show, they also had episodes showing Rawlings losing money on cars and going through all the things that DID go wrong with a build. Some of it was staged, and they made no bones about letting you know it was staged.
Sorry to hear Kaufman left. He's a really smart guy. But, there were some builds where it was clear there was lots of tension between him and Rawlings. Rawlings must be tough to work for as there has been a lot of turnover in his shop.

So, the CTS is still awaiting a part that's backordered. As such, they don't want me to drive it as it is a safety item. And, once they get it in, it's supposed to take 2 days of labor to install. I promise to stay calm. But, they called and wanted to know if I'd be interested in driving a CT6 until the part comes in.

As much grief as Cadillac has caused me, I like their current vehicles. The CT6 is VERY nice. White with saddle interior. The GPS/control screen is high resolution, and is as big as the first TV I ever bought (j/k....but not much).
Steering is a little disconnected, but accurate. Not as much understeer as I expected and weighted almost perfectly.
It's a BIG car, which makes its handling all that more remarkable. Lots of work was put into the suspension, it's obvious.
This one is the 3.6L. Sounds expensive. Fast for this type of vehicle. I still like the torque in my CTS 4 cyl turbo.
Seats are quite comfortable.
Braking is "spot on"...not too hard, not too soft, great pedal feel.
Very high quality materials throughout. Soft and supple leather, carbon fiber trim, stitched dash and doors. Auto Park feature. Radar cruise. Stereo is excellent. HUGE sunroof.
Feels like the proverbial vault from the door closing to the feel of all the controls in the cabin.
Can't think of anything the car is lacking. Not sure how much one of them costs (no sticker on it). But, it has to be in the $60K-$70K range.
If Cadillac can ever get their act together on getting parts to repair their cars, they may actually start to do well.
Some years back I would have agreed with you. But for me, their shtick (esp. Clarkson's) got old in a hurry the last few years, and it seemed very forced. I stopped enjoying Top Gear around 2012 or so.

If the hypocritical old eco-weenies want to get people out of cars (of course, they won't give up their own cars, but everyone else should), they need to aid the well being of pedestrians. Their dumbo "vision zero" garbage doesn't matter, something with teeth is needed. Maybe question some of the bloated bennie offerings to fund it until it becomes self-sufficient, as I suspect the local driving talent will be slow to adapt.

This morning, I'm driving on I-95 South from Boca Raton (Palm Beach County) and all of a sudden, a traffic message replaces my odometer and fuel economy gauges at the bottom of my main instrument cluster below the speedometer and tachometer stating, in bright yellow lettering and black background, "...objects in road ahead, caution!" Then, on my iDrive main screen it repeats the message and asks me to acknowledge that I've read the traffic alert message, yes or no? I click "yes" and make an assumption (my first mistake was assuming something logical would ensue) that the caution alert message would disappear. Well, I was wrong (should have known)! I try clearing the alert using my "clearing" button at the end of the directional signal stalk on the steering wheel, and it does clear the message - for 7 seconds - and then it reappears. So I cannot clear the traffic message for longer than 7 seconds. I did notice trash and remnants of a possible earlier accident on the right lane, but I had passed that juncture 10 miles ago.
So I call the BMW dealer and they told me to bring the car in since the car was less than 2 weeks old. Since my driver's side windshield wiper was "chattering" in moderate rain, I thought this would be a good time to kill two birds with one stone. So I make the 30 mile trip out to Pembroke Pines and I wait for about an hour for my advisor to "buzz" me on the pager I was given when I first arrived in service to alert me when the service advisor was ready to see me. We go out to the car and of course the traffic message had disappeared. I swear to the advisor that I am sane and have all my mental faculties - "...Ms. Service Advisor, the traffic alert message could not be "cleared"! It was there for almost an hour and even the valet who took my car and keys saw the error message!" I am looked at like I was crazy, of course, but I catch sight of the valet guy and he verifies my story about the traffic warning message. Thank goodness for small miracles - at least the next time I come in complaining about something, the advisors won't roll their eyes as I walk by - whew!!!
The shop foreman is now summoned. I relate my experience with the traffic alert message - and he responds something along the line of, "...oh that's nothing, there are dozens of different alerts that will come up on that screen in the instrument cluster to warn you of accidents, heavy traffic, debris on the road ahead, construction, etc., to name a few..." he states. He adds that I shouldn't worry about not being able to clear the warning - it will clear itself when the car's computer goes to sleep! It seems that the engine has to be shut down and the car locked and I have to be at least 20 feet away from the car before unlocking it
Well, here's hoping I am not bombarded with traffic messages that cannot be cleared. I am not a fan of driving 60 miles round-trip to the service department to have them take the technical pulse of my car. I have enough problems with my doctors taking my own pulse!
At least they replaced the driver's side wiper - something accomplished!
