    the other quick check is to take a different, identical car out for a test drive, and see if it does the same thing. If so, it probably just is the way the car is designed, or as Texases noted, the way you have the controls set. My TLX tends to blow cold air even when I have the AC off, but the fan on (to just get some circulation) and I never use the Auto setting. I think the car is just trying to keep the car at the temp selected.

    anyway, try it on another unit, and if it does not do the same thing, you have a pretty good arguement that there is a problem with your car, and make them look at it. And keep copies of everything (repair receipts, and document in detail every conversation with them, names dates and details).

    Lemon Law is not easy to do, and it requires allowing the dealer a certain amount of times trying to fix a problem, and the car being out of service for a certain number of days. So until the dealer has had the car multiple times for the same issue, and unable to fix it, you don't have the basis of a case.

    on November 2nd 2019 i went to South Point Dodge ( an approved plus dealership with my bank RBFCU) in Austin, Texas to purchase a Challenger which i had a guarantee sales price certificate from there website for $32600 and i was approved through my bank for $40000. The sales manger offered me 28000 trade in on my truck with a 32000 balance, upside down 4k. he started asking income amounts and i told him i was already approved through my bank and not to run my credit again, he swore he would not, but he did. when i went to financing it had 23k for my trade, we agreed on 26k. they rewrote contract and i noticed the new car was priced at $46800, $700 above full sticker and way above $32600. they wrote another contract. i declined all there extras then they printed another contract with $3700 of stuff i just declined. it was closing time Saturday night so i took home the new car and returned Monday morning, the new price on the car was $46100, the sticker price. the sales manager started pointing to numbers saying here is the $4850 rebate and here is a $6000 rebate that makes it $32600. i signed it and they gave me all the paperwork to take to my father ( a co-signer) to sign, he never went to the dealership and they ran his credit too. i called my bank to go over everything and they said they actually added $6000 to pay off my truck and that i paid full sticker for the car. i went back to the dealership and spoke to the sales manager and asked him about the guaranteed price and he smiled and said " the guaranteed price means that i guarantee you aint getting my car for that price and told me to get the fu#k out of his store, the deals already done. my bank removed them as a recommended dealership and the dealership fired the manager and i have a $50000 car. Do i have any legal rights in this situation?

    Father, 84 years old bought a brand new 30k truck on his own. bought it without telling any family members. He is on a fixed income & cant afford it. Can’t sell since it just came off the lot
    I know dealer will not take back, not in the business to buy cars back. Frustrated that he made such a hasty decision..
    BTW, has a truck that works fine but did not use as a trade in!
    Any ideas on what to do?

    Unless he has mental deficiencies of some kind, he might be out of luck. If you think that is a possibility, then maybe make your case at the dealer. That is a really high bar, though. If he doesn't already have a guardian, you probably won't win that battle.

    Maybe, try selling his old truck for as much as you can get? That might be cheaper in the long run, than trying to sell the new one. You have to balance the cost/benefit to see which makes the most sense.

    I feel for you. My uncle, who is now 91 yrs old... traded cars two to three times per year, from age 79-89. He had the cash, and didn't really get screwed more than once or twice. I think it was a symptom of depression/loneliness. He liked the attention. I couldn't get him to stop.

    Of course, I didn't really expect him to live this long, and the extra $50K he blew by trading so often would come in handy, now.

    I wish I had some really good advice. :(

    2020 New Explorer. Had it 5 days and I noticed that the driver side of the hood didn't line up with the fender (it was lower). The passenger side is higher than the fender. Figured just a small adjustment. NOPE. It has been back at the dealer and in the body shop for 4 full days now and they have now told me it is having the front end entirely redone. The fenders were also off. Won't have it til next week. What can we do about this horrible factory defect. The dealers guess that they tell me is that on the assembly line one part went on incorrect and everything after that followed suit. I'm wondering about the frame. Did it get damaged through transport? I don't want anything else off that assembly line. Would swap for a high end F150 possibly, What can I do? Can they make me keep this factory problem?

    I'd raise holy heck, and tell them to get you a different vehicle. That they obviously sold you a defective vehicle from the very start.

    I don't know if they can make you keep it, but if they aren't sympathetic, tell them you'll look at legal options.

    just purchased a 2020 kia soul which had a manufacturing paint issue before i even drove it off the lot (missed spot) which they agreed to fix and even tho i was upset, agreed.. (but i thought if they missed paint what else did they miss) also i did mentioned night one that the drive felt off .. went in and out of service confused why the car felt this way getting no answers.. then the engine light came on after only 3.5 weeks.. they thought it was the gas cap at first, cleared it 2 days later and it came back on and stalled twice so i took it back, said it was a evap leak and would check with kia for a fix and options.. ( still having me drive it,saying it was safe, even tho it has stalled and i didnt feel safe..) they get back to me a week ish later and say it needs the entire engine replaced. i honestly dont have any faith in the model and would like a new car but they will only replace the engine and said thats all they will do. what are my options here, putting a new engine in a brand new car that seems like a lemon does not feel acceptable.. (canada)

    First thing is to research the 'lemon law' (or whatever it is called, if it exists) in Canada. Also, document every visit to the dealer in writing, and get something in writing from them.

    Trade it on something you like better and take the money hit if you can afford to, otherwise learn to like it.

    I bough a NEW 2020 Mazda CX30. The car already had a CLEARBRA on it, so I had to purchase that because it was the only white car they had. Anyhow, I noticed that the CLEARBRA was not applied properly and told the sells person, he told me to bring it the next day, so I did. I picked up from the dealer that afternoon and notice that it has small blue splashes all over the front. I told the salesman and he said that it was the glue they used to place the CLEARBRA. Anyhow, after three trips to the carwash and one at home trying to do a hand wash, I realise that the blue spots were not coming off. I emailed the salesman again and he told me to bring it back to the dealer, so I did. The service department told me that it was paint and the salesman said that probably it happens when I was driving. I reminded the salesman that I mentioned to him when I picked up the second time that blue spots were all over the front of the white car. The dealer has not given me any options and they are going back and for with excuses. What can I do?

    Call the dealer and ask for the Sales Manager and/or General Manager.

    And if that's not working, call Mazda customer relations, the number is in your owners manual. Also, make sure every complaint and trip to the dealer is put into writing/computer record.

    I bought a brand new 2020 Ford Edge. While driving down a smooth road, no one in front of me, no over passes, etc, the panoramic moon roof exploded like a bomb. The thing had a cinder block size hole over the console. The Ford place charged 1,100 saying a rock flew up and hit it, which is bs. Plus a rock wouldn’t make that big a hole. They refuse to admit that it was a defect, kind of like saying you bought it, it’s yours now. My deductible is 1000. I hadn’t had the time to rewrite the insurance policy because it happened just after two weeks. I don’t think it’s a my problem, I think Ford should do the right thing and fix it. What are my options?

    We don't give legal advice, but your payment/loan has little to do with whether you can return a vehicle. Generally, if you bought it, it's your vehicle.

    Hello, my friend just returned a Honda HCRV in exchange for another because of a mechanical issue. This in my state is rare. It’s the 1st time I’ve heard of it happening. State laws on this differ as well as what is in the sign contract. The dealer will try everything possible to discourage the practice of returning ALL of your money for the vehicle, that I’m positive about. Keep in mind the vehicle from wall work trucks is legally used, and worth less. Which makes a carfax report even on a new car something to think about. If I found I bought a new car previously owned by someone else, even 1 day, I’d be at a lawyers office discussing litigation for damages.

    We have same problem. New Kia Soul 2020 S w 4,500 miles (bought in Sept. 2020). Check engine light came on during cross-country trip. Engine knocking sound. Took to a dealership, they cleared it — oil was 1 qt low so they topped it off. Said to get it checked again in 1,000 miles. Stalled once. Check engine light came back on while we were driving home and car stalled out 4-5 times while doing errands. Next morning, check engine light was off again. The Stop and Go feature works randomly, regardless if the feature is turned on or off. Car is not safe.

    Local KIA service dept. mechanic wouldn't open a KIA ticket on car. Told a bunch of lies. Added another 1/2 quart oil. Said he couldn't duplicate problem.Then on my way out, he said it will probably need a new engine.

    Drove an hour to a third KIA service dept. They say something is clearly wrong, but can't look at engine for 2 weeks. They also mentioned that it looks like it's burning oil and it probably needs a new engine. In the meantime, we have to drive cross-country again (family emergency) and will have to rent a car. $800+ No loaners available. No help or recourse from Kia or the dealership.

    We don't want a new engine in a lemon car, either. If we can't use the car for a month, then we qualify for NY Lemon Law: replacement or refund. But if they get it repaired sooner, we just have to keep the car. Which stinks. Any suggestions?

    if they replace the engine it should be fine. Lemon law is not that easyto win, but you can try. make sure to keep impeccable records. Every piece of paper, names of people you talked to and dates, etc.

    Hard when you are not dealing with a dealer you have a relationship with (I assume it is at least local to you?)

    once the engine is replaced, you can always trade out of it if you want.

    My girlfriend recently bought a 2018 toyota yaris IA with 32k miles from kendall toyota. The carfax had an accident reported but it was minor (it was her first time buying a car). I know it was already a mistake buying a car that had an accident reported, but in the first three days we found out the gas mileage was way off and the gas gauge was not moving even when the gas tank should have been halfway empty. The range for a yaris is around 409 (i know it wont exactly be that but I was expecting 360-380 miles in range). When we tried to fill the tank with 205 in range, it only took 6 dollars and topped off at 239 miles in range. When we got it from the dealer the gas range was 310 (around that somewhere) and we couldn''t even bring it up to 300 in range after filling up. I also noticed that the carfax reported minor damage to the front-left of the car, but they also replaced the radiator and the A/C hose (on a 32k mile car?).
    She bought it and is financing it, she got the car around april 3rd, we are going to the dealer on friday to see if she could swap it out for something else (but i dont want her to trade it in as the value of the car will definitely not be what she payed for and she will end up owing more money). But i just find it so strange that a 32k mile car is already having gas tank issues. Whether it be the sending unit, the electronic gauge, the fuel pump, the evap vent, or the tank itself, those things are meant to last the lifetime of the car. What are her options?

    Do not worry about the gas range readout, the gas gauge is the immediate problem, it needs to work. An inspection will cost about $100, but in her situation I would take it to a reliable independent mechanic (check on Google and Yelp), and have them inspect the car to see if there are any other problems resulting from the accident, or otherwise. If the car is in good shape, then I'd ask the Toyota dealer to fix the fuel gauge system. If there are bigger problems, I'd ask the dealer to swap out this car for an undamaged one.

    As for the radiator and a/c hose being replaced, I'd guess that happened as a result of the accident, which means it was more than a 'fender bender'.

    Is it still under warranty, at least powertrain? In case something might be covered. Also, many dealers (and some states require) offer a short warranty (30 or 90 days) on a used car purchase. Even if not, you have a good argument that the car had defects when they sold it, and the dealer should be willing to correct them.

    So I would get it in ASAP to be looked at. And see if they will take care of it. But don’t expect them to take the car back. Well, they will certainly trade her out of it, but at a cost to her.

    Assuming they fix whatever gas gauge glitch exists, car should be fine. And range displays from a trip computer are notoriously inaccurate.

    Got it! Thank you so much for the quick reply, ive been stressing about this since monday.
    I think that is what im going to do. I checked the contract of the car and it no place does it say that it was sold as an "as is" car so that calmed down. However it explicitly states that it has NO cooldown period. It also says the seller does not offer a warranty, expressed or implied. Im going to take it to get inspected today after work to see if it has any major problems (hopefully it does not). If , however, it does what are the chances they would swap out the car (without needing to treat the current car as a trade in?) ?

    Depends on the dealer. And their business practices. But having something in writing gives you a good case. And be polite, not confrontational.

    Nothing in the transaction would void the manufacturer's warranty. Is that still applicable? How many miles on the car?

    @stickguy Yeah, im going in with a calm demeanor and just hoping that somehow they can fix this problem for her. But I will definitely provide a vehicle inspection report if the mechanic finds something majorly bad.

    @texases The car currently has 32k something miles, supposedly it has 300 miles left on the original Toyota warranty. Would the dealer take care of it if its still under the original warranty?

    If it has 32k miles, the next question is when was it originally purchased? That's also known as the 'in service date'. The dealer should be able to tell her. It has a 36 month/36,000 mile warranty on the car, plus a 60 month/60,000 mile warranty on the power train. I don't think the gas gauge system fall under the power train warranty, but does fall under the overall warranty.

    @texases ahhh okok, it was originally purchased in 2017 and only had one owner. So ill definitely try to get them to fix the gas tank since the original warranty is active

    I agree with getting this vehicle inspected. I am afraid you may find more problems. Is the mileage really 32K. Unfortunately the mileage adjustment scams are still done today. Hopefully the dealer will come up to the plate in regards to issues such as gas tank. As above I am concerned the warranty may be expired.

    I just bought a car and within a couple of days it started to have problems. I took it back and they said they would check it and work on it, they gave it back after two weeks then again the first hour of driving it, the same problems occured and called the dealer ship and told me to take it back. It has been more than a month now and it is still in the dealership. They still charged me with the first payment but I now feel like the car is not worth all the money I bought it for and I really don't feel like it is in a good condition for a new purchase ,... can I do something about it?

    Is it a new or used car? Did they give you a loaner to drive?

    If you haven't taken delivery, or turned over your trade-in, or given them any funds, you can back out of any deal.

    - Luis is one of the gardeners that works for my property management company. Last week his work truck was stolen. He went looking for a replacement. I was told that he needed me to sign as a cosigner so that they would give him the loan. Which I agreed to do.
    - I specifically asked if this would in any way appear on my credit or affect my credit. They said “no”.
    - I asked about what type of inquiry would come up on my report – hard or soft? He said “well we have to check your credit”
    - I asked again “just one simple credit check, right? One small inquiry ding?” He said “Yes”
    - Today I checked my credit – turns out they ran FOUR inquiries on my credit. Not One – FOUR! Alarming to the point that my mortgage company contacted me twice to find out what was going on.
    - They asked for all my personal info on the phone. Then they asked me to send a pic of my i.d. I asked “why?” He said it was to confirm who I said I was.
    - Then the salesman asked for my insurance info. Again, I asked ‘why?”. He said that Luis would not be able to drive the car off the lot without it. I said – No. I am not buying the car, he is. Why should I have his car on my insurance. He said Okay & left it at that.
    - At 630PM I get a text from Luis asking if I was home. I said yes.
    - At 7:45, there was knocking at my front door. It was Luis & the salesman (David). They said “we need you to sign on the contracts. I said OKAY – NOT knowing that they had created all the contracts in my name only. I thought I was cosigning and nothing more.
    - It wasn’t until I sat down in front of the contracts and began signing that I realized something wasn’t adding up. I asked David “where does Luis need to sign?” I was told “He doesn’t.” I asked what he meant by that, and David said “Oh – didn’t anyone tell you? Yeah – you are the only one on the contract. We couldn’t put Luis on the contract at all”….
    - “excuse me? So what does that mean?” he says “That you are buying the truck”. I was completely caught off guard. Not Once had that been said to me, or I would have said No right away. But here they were, at MY House. Telling me to Sign. One on each side of me. Then I look up to see that they had a 3rd person with them that was driving the truck around the block due to lack of parking (we were sitting outside). I was in a state of shock – I was angry. But I was in shock, so I continued to sign.
    - When they left, they took a fingerprint – he said for the DMV.
    - They also took with them Every single page that they had made me sign. I was left with not one copy of anything.
    - As they drove off, I felt myself shaking. I sat & stared at the wall for a good 10 minutes trying to understand what had just happened. And everything started to sink in:
    - I had just been intimidated and manipulated into signing papers for the purchase of a $55,000.00 truck, for which I received no benefit yet carried 100% of the liability.
    - They drew up all the paperwork without my consent. I had NEVER given my permission to do this. Yet it was done.Now the finance guy says the only way they will take the car back is to show it as a repo on my credit. Can they do that? would I have a case?

    I purchased a 2017 impala from three way Chevrolet in bakersfield Saturday by Monday the rear end was making a scrapping noise. I called the sales guy I bought it from and told him I wanted to return the car. He said bring it in. I work out of town. I took it in on Friday and they said bring it back on Monday. So I took it in on Monday and they've had it since. No loaner I've asked and asked. Can I return this car?

    I purchased a 2019 Ford Fiesta from Ewald Venus Ford. 5 days later the car's Transmission Control Module went out causing me to pull off the freeway and losing complete power. This was at 3:30 AM (coming home from work). I had the car towed to the dealship, During business hours that day, I contacted the dealership and they agreed to lend me a loaner because it will be 5 or more months before they could attempt to fix it. Now a month later they want me to bring the loaner back and they would give me a rental car. They did say they would pay for it; however, it seems my insurance won't cover the cost of the rental car. So, now Im looking at having to purchase insurance to cover the rental. The worse part is Ewald KNEW the vehicle had the defect and still sold me the car.
