Thanks for the advice. I will wait for a few thousand miles, and then check the mileage.

I got a vehicle financed on Monday 7/3/17 I want to return it because I truly need something bigger and want to return it. It's a 2009 Pontiac torrent and I didn't even know they went out of business. Do I have any recourse? Is there a such thing as buyer's remorse for cars.
  • stickguystickguy Member Posts: 53,330
no, there is no such thing. You bought it, you own it (well, whatever part the bank does not own).

You can certainly go back to the dealer and ask nicely if they could swap you into something more suitable, but they don't have to.

really the only thing you can certainly do is trade it in on something else, but expect to take a bath on it.

To answer your question, yes there is Buyer's Remorse and this is what you are feeling.

As suggested, you can possibly trade it in but it probably will be a costly swap.

I co-signed on a loan for my son yesterday. He drove off of the lot and went straight to work. On his drive home last night 3 different service lights popped on. He has not had the vehicle for even 24 hours. Do we have any recourse to get theses items fixed by the dealership? We are in Ohio. Thank you.

It's a used car without warranty? Probably not.

But, you could call the dealership and ask for some relief. The loan and whether you co-signed or not won't have anything to do with the car.

My wife and I recently purchased an Audi Q5 from a dealership in Austin. We were told by the sales person that we should not bother looking at a Lexus or Honda product because they were being mass produced in the U,S and could not compare to the quality of Audis which are manufactured individually in Germany. We later learned that our car was manufactured in Mexico, something that had we known at the time of our visit to the Audi dealership would have kept us from buying the car we did. We were also told that the only Q5 available with the trim level and price we wanted was at another dealership and would have to be purchased as a trade. We were told that the car could be delivered in 5 days. It has now been 11 days and still no sign of the car, nor can anyone tell us just where it is in transit.
We were also told by the sale manager at closing that since we didn't have a letter of credit from our credit union, and it being on a Saturday, that we would have to sign for a dealer arranged bank loan at a higher interest rate than we thought we could get from the CU. We felt sure that by Monday morning we could bring the letter of credit to dealership and avoid the need for the loan with Bank of America. We were later told that the bank loan had been finalized and processed on Saturday, which turned out to be true. At closing my wife also noticed that the sales manager had tried to increase the price of the car $1,000 above the price we had agreed to. He quickly changed the number claiming it was his mistake. Now 11 days later we are still awaiting the car and are paying interest a full 1% higher than we need to daily.
I think they call this the school of hard knocks....lessons learned!.

if they have not delivered a car, you should be able to get out of it. Also should never sign papers on a car that is not there in front of you (a buyers order to hold the trade doesn't count).

you can also always pay off a loan. if you can get a lower rate at the CU, get it and pay off the higher rate loan.

@learner3 - in addition to the good advice you've been given, I want to comment on "We were told by the sales person that we should not bother looking at a Lexus or Honda product because they were being mass produced in the U,S and could not compare to the quality of Audis which are manufactured individually in Germany. We later learned that our car was manufactured in Mexico, something that had we known at the time of our visit to the Audi dealership would have kept us from buying the car we did."

First, ALL cars you will ever consider are mass produced, regardless of brand. Second, Lexus and Honda products have been found to be more reliable and, to my mind, higher quality than most all Audis, BMWs, and even Mercedes. While German car quality has improved over the last few years to approach Toyota (who makes Lexus) and Honda (who makes Acura), they have been much worse in a number of prior years. Finally, there are plenty of high quality cars made in Mexico, certainly the equivalent of many made in Germany.

I purchased a used vehicle about a month ago and the same day that I purchased it, it had the engine light on and when we were on our way home we put fuel in the vehicle and it would not start. This was a Saturday and they were already closed and were closed on Sunday as well. We contacted them the very next business day and they said to bring in the car so we did and have returned a total of 4 different times and the vehicle is not no starting properly. I have not made the fist payment yet which is due here soon, I did contact the finance company to see if the deal could be reversed and they pretty much said it would be up to the dealership. I did go back a 5th time and all they said they could do was try to put me in a different vehicle which they did not have any vehicle in my budget. I did just leave the car there and left. Now I don't know what to do, I originally bought this vehicle for my son who is at college for him to get back and forth and I let them know how important it was that we get a reliable car and all this happens. Any suggestions?

So I signed paperwork for a car so they would hold the car for me I did not give them a down payment or any kind of money. I also did not drive the car off the lot so it’s still just sitting in their lot. They were giving me a few days to find a co signer so my payments wouldn’t be so much. I wasn’t able to find a co signer so I will not be able to afford the vehicle can I back out of the contract?

I purchased a 2018 Jeep Renegade Sport at the end of January 2019. The vehicle did not have certain options that I was not aware such as automatic headlights and floor mats to name a few. I really wanted a vehicle with remote start and heated seats as I live in Michigan. As part of the sweetening of the deal the salesman agreed to put after market remote start and heated seats. The day I picked up the vehicle and used the remote start I realized it was not only starting the vehicle but unlocking ALL the doors for anyone to help them selves to content in the vehicle. I reported this to the dealer and the shop that installed these features. They were unable to figure out why it was doing it but wanted the vehicle back AGAIN to try and fix my dilemma.

After a week of absolute frustration I approached my salesman and said why don't I bring this back and buy the next step up, a Latitude? The answer was sure we can run the numbers. Well according to them because the car had been driven off the lot it was now considered a used car for trade in which ultimately cost me an additional $7,000 which I was so frustrated at that point I finally agreed since this would get rid of the headache Renegade and put me in a much better Renegade that would not have those problems. The day I took possession of the Renegade Latitude, February 6th. One week after I had purchased the first one and only 300 miles later I was the proud new owner of a $33,000 dollar Jeep Renegade Latitude, problem solved right? not so fast. I found out the very first time I used the remote starter when I touched the door handle, "Passive Entry", or actually get the lever pulled out, or if I got as far as getting the door opened and starting to enter the vehicle or as I was approaching the vehicle and unlocked it using the FOB all those conditions would cause the engine to shut off. I really don't feel like climbing through a window just to keep the engine from shutting off. Remember, this was the very reason I agreed to the idea of buying a much higher priced Renegade as it woud surely take care of the problems of Renegade #1 right? NOPE. I reported this to the dealership the very same day and left it for them to work on it. When I picked it up after keeping it overnight they said they could not replicate it so nothing could be wrong. REALLY! So the next day at work I decided to film me starting the vehicle with the RS and walking up to the vehicle and touching the door handle and yes, the engine shutting off. I took off straight to dealer and showed them the video and had them come out and see for them selves. I also reminded them of the problems I was having with the Uconnect Radio locking up, becoming totally unresponsive and unable to change the temperature, control the fan, change the channel etc. This required me to pull over, shut vehicle down and restart. usually it would reset. Later that day they called and said you can pickup your car. We found some good news and bad news, there is a bulletin that has been out since 4/2018! describing the remote start issue, GREAT I thought, NOT great, as it clearly stated there was "NO KNOWN FIX FOR THIS PROBLEM" ARE YOU KIDDING ME? AND YOUR RADIO/u Connect IS DEFECTIVE so we have ordered you a brand new one isn't that great they said until this, we ordered it but they are all on back order with no known date of availability! They continually tell me they checked and there is still no fix but be patient. I have been patient for over a month and am no closer to a resolution and the miles are stacking up which is depreciating the vehicle day by day. I am at the point now that I want a different vehicle. If by some miracle they do fix it what happens if it happens again and again.

I have kept every single piece of paper, every single email, text message voice mail with dates and who I was dealing with.

Do I have a case for a possible Lemon Law claim? I asked them in the first week to let me bring the first Renegade back (Return it) but was told no they couldn't do that.

I purchased 3 year old Nissan Murano from the dealer month ago. Driving home I found that’s the car was not properly prepare for sale. The maintain light showed “oil and filter” and all fluids were very low including the power steering one. I was charged $ 895 for the service not done.
Also the base price of vehicle was higher I verbally agree with salesman. Now I found I was charged $ 600 commission for selling me contract for Tire and Wheel Road Hazard (Contract price $ 995). I accepted the contract price but was not told of commission fee hidden in base price.
Is anything I may do to be reimbursed for both charges? Do I have any legal rights?
I notify them about the first issue immediately after purchase.

Not much you can do. Besides, you don't actually know if the other dealer is being straight with you on price. That's a nice car, so enjoy it and just accept the way things worked out. Maybe the dealer you bought the car from is a better dealer for service, or more convenient for you.

You could probably get a re-imbursement on the service that wasn't done, or at least get it done properly--that's a very legitimate request. I am curious, though, why you had to first buy the car and then pay for service at the same time? I would think the dealer would prep the car for sale beforehand and just add that to the selling price from the get-go.

As for the second problem---well, a contract is a contract, and if those charges were plainly listed, and you signed it, then I don't see where "legal rights" come into play. Of course, you can ask them to reimburse you for a package you didn't want, and they might do it--especially since they may have screwed up your service on the car.

Ask nice, play nice, and good things may happen.

My credit is borderline fair. I have had some issues in the past. I went to Cape Cod Carz in Hyannis MA and asked about pre-approval. I was told the only car I could qualify for was a 2014 Chevy Spark listed at $4995 on the website. I went in the next day thinking it was all I could get so I settled. I put $1000 down on the car and signed the paperwork. I was confused because the dealer listed the purchase price as $8625 not $4995 and added a service contract for $1399. Desperately needing a car I signed then took my rental to the mall while they went to the registry and brought the paperwork into the food court to look over. Immediately, I knew something was wrong and called the owner Rick (who put together this “miracle “ deal for me). When I asked why the car was $8625 not the $4995 listed he told me “I had to mark up the price of the car and add the warranty that’s the only way I could get you approved” BULL*#%! I am basically paying an almost extra $4000 that he is pocketing at a nearly 21% interest rate. I called my loan company and tried to submit a complaint. I had a copy of the car with the sale price on it and all my paperwork. They refused to escalate it because the VIN wasn’t listed on the brochure. Question: How many Lemon Yellow Chevy Spark 5 speeds with 64,000 miles do you think this small used car dealer has? I need out of this deal. I tried to bring the car back but the owner ( again Rick) wouldn’t refund me my deposit (knowing I would need that cash to go elsewhere for a down payment) he told me I would have to get an abatement at the Registry which could take a month or two. I mentioned loan fraud. He offered me $500 back to keep the car and I didn’t know what to do. I would have had to rent yet another car and I’m a single mom living on disability. I took the $500 and the car because I was DESPERATE and felt like he gave me no choice. I contacted the MA Attorney General’s website and filed a complaint. But I need to know if I should get an attorney and fight this. My thought process is - if he did this to me, how many other people has or will he do the same thing to? He blatantly took advantage of a lower income single woman and I don’t want him to get away with it. What should I do? Any thoughts would be extremely helpful.

I'd say your only hope is to consult an attorney.

You saw red flags every step of the way, and yet, still signed for the deal.

I just bought a new car. We have agreed on a financing and already payed a down payment of 5k (4k on credit card and 1k on check), I still don't have the car in my possession and are going to pick it up soon. Is it possible for me to refund the process? Would it impact my credit? Edit: The dealership is moving the car to their location, like a dealer trade.

They have $5000 of your money. And, you've asked them to incur a cost to transport a vehicle. You can probably get out of it, but expect them to keep some to cover their transport costs.

One more thing, the car we are financing costs 50,770 and we also were able to drop about 1k making it 49,770. We placed a DP of 5k, like I said before, and the montly payment is 902. The apr is 1.9. Shouldn't the numbers be way less?

Do you have the "Amount Financed"?

    What about taxes and fees?

If you "signed" for the vehicle, did you sign a contract with all of the terms spelled out?

If not, you are just guessing, and we would be guessing, as well.

i received a print out of my total cost for a 2019 toyota corolla and went to the finance office... I was exhausted and gullible and looking at my contract i noticed they tacked on a $3500 service contract. During the process i was told "And i got you 5 years free service oil changes, all maintenance etc!" Apparently this is what he meant by the extra 3500$ tacked onto cost. It's been 7 days. Is there any way to get out of this $3500 service contract. The cost practically adds on an extra year of payments... I feel so stupid. I had been in that salesroom for hours and i signed everything thinking i was paying the amount previously shown to me without the "service contract." I still want the car just not the service contact.

You can probably get out of the contract, but if you financed, any amount will be deducted from the loan balance. You'll save the money, but your payment won't go down, but it will reduce the number of payments you have to make before it's paid off.

I was going to trade in our Chevrolet Traverse on a new Hyundai Santa Fe as a surprise for my wife. The title to our Chevrolet is actually in my wife’s name. I made the deal and signed papers and came home with the new Hyundai. My wife went bezerk and is furious with me. This was Friday afternoon..it is now Sunday afternoon. Is it possible for me to return to the dealer tomorrow morning to cancel the deal?

If you can't provide clear title to the Traverse, it seems like you'll have to. (unless you get your wife's permission). I'd definitely stop driving the Santa Fe. You might have a mess on your hands.

I bought the Toyota Corolla in April 2018 from AutoNation Toyota with 2,5 years of technical service. The car was in service at least 3 times and every time I asked the personal to fix the break since it making strange noise and it makes me to feel like I am driving the time bomb (This complain is recorded in their papers). Every time I had answer that everything is checked and the car is fine. Couple days ago I got a break failure and was fortunate not to kill anyone but car is wrecked. I towed the car back to seller AutoNation Toyota and claim the manufactory defect. I will never sit back in this car and I am looking for option to have my money back. The company said they will investigate this case but this morning they called to give an estimate for repairs. Please let me know how can I make them to understand that this is their fault of selling me defective product and not fixing it. Therefore I am seeking for full refund and reimbursement for towing.

I do not think you will be able to get your money back. A few questions for you, however:

What year is the Corolla you bought?
How many miles were on the car at that time?
When you took the car in for repairs, was it to address the same problem each time? Is that documented in the papers you got from the dealer?

Toyotas, in general, are pretty reliable cars. But, a bad one can be found here and there. You may have to retain the services of a lawyer, going forward.

Yeah, that's going to be a tough battle, but one he can still lawfully win, nonetheless.

We bought a 2013 Nissan Sentra. We noticed the transmission slipped a couple times during the test drive. They told us they’d top of the fluids for us, it’s probably low. We buy it, drive it more the first day & it had more and slipping and now sputters. We research and find out 2013 Nissan Sentra cars are notorious for transmission failure and replacement that costs about how much we just paid for the car! I stopped payment on the check & we are returning the car in a couple hours. This is [non-permissible content removed].

I financed a 17 honda accord sport today for internet price $19,232 after taxes and gap and 5yr warranty 24,800. They gave a borrow car until the actual car I want is ready which will be Tuesday. I want to unwind the deal because payments are 478/ monthly he claimed to have helped me out on the warranty by getting rid of the interest but I still think the deal is incorrect because i have not actually seen the car im getting or drove that car they also paid off my loan on trade. He gave me a shared drive and said the contract was on the drive but when i hooked it up to my chrome book and nothing is there on the drive could he be changing things back at the dealership

If you have not taken delivery of the vehicle, then you should be able to go back to the dealer and ask them to unwind the deal as you're not comfortable with the terms. Keep us posted and let us know how things turn out.

We just bought a Toyota Sienna 2019 last April 29, 2019. Last month we got a low oil warning, took it to the dealership and got it fixed. Last week, again, another low oil warning showed up and since then, the minivan is still there. It has been almost a week but they are still not done fixing it. I have 2 children that we take to school everyday and I am very uncomfortable driving a new car that has recurrent problem. They had to take down the engine to check what was wrong. Is this situation can be considered for the Lemon Law?

Give us some more details. When the low oil warning went off, did you check the oil? Was it low? What did they do the first time to try and fix it? Is it a low oil pressure warning, or a low oil level warning? You may need to check your owners manual on that.

As for lemon laws, check the requirements in your state. You'll want everything between you and the dealer in writing, of course.

We bought a used 2010 Chevrolet Malibu for under 10 grand. We made a down payment of $3,500. And an additional $1,000 in 30 days. The car salesman noticed my truck and asks if I am the owner. I said yes I am the owner. He says “my boss is willing to sell you this car if you hand over your title to your truck. We will give you your title back until the $1,000 is paid”. I had no problem with letting them have my title till we paid the money. We bought the car. Only had it for 4 days and we were unsatisfied with it. My boyfriend then calls the dealership twice and they did not want to give the down payment back. So we go down and talk in person. A manager says “that simply can’t happen. We’ll give you your title back not the refund.”. So we got my title back, dropped the car off and left.

bought new car off show room floor. I've had 1.5 weeks and it has been in service twice - total of 4 days within 1.5 weeks and now say they have to change out the entire rear differential. I bought the 2019 Nautilus Black Label not to have maintenance and this happens immediately. Can i reject it or ask them to get me one from another dealership? I could have bought a porsche but didn't want the maintenance - now here i am.

you can ask nicely, but the dealer can't do anything about it on their own. If you want to try you probably need to open a case with Lincoln corporate. But, the first step is always going to be for them to try and fix the problem. It sucks, but sometimes you get a defective part. If the 2 visits were for the same issue (I am guessing they tried a simpler fix, it didn't work, now they are just replacing the whole unit?) then they are following the normal process.

Hopefully they can resolve the issue (and have you in a loaner) and you can then just enjoy the car. If they can't fix it, and Lincoln does not want to step up, your only real recourse is to go down the lemon law path.

We just recently purchased a 2019 Kia Optima S a month ago. When driving the car with the climate off (heat and AC)
there is still heat blowing out of all the vents. We notified the dealership, and was told to hit the recirculate button. We did hit the recirculate button which stop the air from blowing out of the vents for about five minutes before air starts blowing out the vents again. We scheduled an appointment to have this serviced to be told that this is how all Kia cars function which they try to make sound like it's normal. We have purchased many new cars, and have never experienced this. For the past couple weeks riding in a car with the climate off, and heat blowing through the vents makes for a very uncomfortable ride. This is completely unbearable to deal with through the life span of this car. How do I go about being refunded for this defective/improperly working vehicle? Is this situation part of the lemon law?

Have you pushed the “Auto” button? I’ve been in cars where the climate controls were all mixed up, which I fixed by pushing that button and using just the temperature setting to get what I wanted.

Have you read the owners manual section on this? If it is a problem with your car, the dealer should be able to fix it.
