    Hi there. I have a question about a dealer’s obligations to share leasing details. Specifically what are the legal requirements for a dealer to share the fine points and individual line items of their lease calculations?

    I have been having a hell of a time finding a new Crosstrek in the Portland, OR region. I have spoken with every dealer within a 90 minute radius of the city. Some are charging a mandatory $3K surcharge over sticker on all new car sales and none are willing to negotiate down from the MSRP given the high demand and low inventory situation (sad, but understandable). Several sales folks have ghosted me outright. Every single dealer except one is listing inventory that has already been sold for more than a week(s) to trick buyers into calling or visiting the dealership. In one case, I had a deposit on a car that I was pushed out of when another customer came in and offered more than the sticker. Their excuse was that I couldn’t make it into the dealer within 24 hours of the vehicle arriving at the dealer, even though I had $500 down and the vehicle arrived three days earlier than when I was told it would. I am a 2X Subaru buyer looking for #3, but these unethical dealers are seriously turning me off to the Subaru brand.

    My question here is about something that happened today with the dealer in Salem, OR. The dealer received a Crosstrek Sport that I was ready to move on. I have been speaking with a salesman for a week or so regarding the vehicle while it was in transit. It arrived a few days early so I processed the paperwork/lease application over the phone to make sure I was locked-in and could pick up my new car today. Here is what happened next:

    - When the lease offer came back it was $70 more per month than my own calculation. When I asked the salesman for the details so I could calculate and understand why there was a discrepancy, he refused to share the MF, RV, taxes or any other fees saying those were unknown until Subaru’s bank signed-off.

    - I challenged the salesman on that assertion, that those numbers had to be know to calulate the offer. The salesman got angry and short with me saying the numbers were what they are and I had to take it or leave it. The salesman kept repeating everything I said with the same question of wether I was going to walk way or if he should submit the application as it was presented to me.

    - I told the salesman I did not intend to walk away but I had to see the dealer’s worksheet how they calculated the offer. The salesman told me there was no worksheet and the offer was just an estimate until they ran the proposal through Subaru.

    - I repeated that they had to have calculated the numbers somehow, even if it was an estimate and subject to change by Subaru. The salesman responded by saying the dealer doesn’t share those details with customers. I told the salesman I wanted to move forward with the deal but I needed to understand their calculation and I was fine with it as presented if their numbers were right and mine were wrong. The salesman said he would have to talk to his manager to get approval to share that information with me. I never heard back from him.

    Was this dealer breaking the law by refusing to share the terms of their financial offer and pressuring me to take the deal as presented take it or leave it? I am pretty worked up right now if you can’t tell. I am considering making a formal complaint to the Oregon State Attorney General’s office about this dealerships tactics.

    Thanks for the note. Since I posted, the salesman emailed me (rather than call) this:

    “If you would like us to submit it as it is now we will, but we won't send over our calculations on the lease. Is this something you would like to move forward with?”

    I am going to find another dealer and another brand. I am also right now in the process of filing a formal complaint with the Oregon State Attorney General.

    I doubt that will go anywhere.

    Dealers are not required to disclose the MF on the lease contract; what you'll see is the total of the "rent charge" (interest) for the lease term. You'd have to reverse engineer the numbers to determine the MF used.

    And, FWIW, Subaru Motor Finance (aka Chase) allows their dealers to mark up the MF by 50 basis points. I'll guess that every dealer in the country is doing so, in these times of low inventory.

    If you can hold off making a deal for some months, that's what I would recommend. Just a lousy time to be shopping.
