For anyone that happens upon this searching for FCA or Ally charging dealers "fair market value" for lease returns. I just talked to FCA and they confirmed "the system" will not generate a "dealer payoff" within the last 60 days of a lease. At that point, the customer has to purchase the vehicle, get the title, and then can "sell" it to the dealership. FCA confirmed it doesn't matter who writes the check, so I'm not sure why this is even a thing. Sure makes for a horrible customer experience at the end of a lease just when you'd think they'd want to keep you as a customer. SMH

Pretty common to prevent this at the end of a lease. But, it's becoming a bigger deal now.

I didn't know this was common, but I have also never sold out of a lease within the last 60 days. I just don't understand the logic and no one at FCA was able to explain why this is the "policy". Are there ever any exceptions? With this policy not being disclosed it seems like a possible case if this happened to an attorney with enough equity in the car the ROI might be there. *wishing I had a twitter following*

#2 is the key point, I think.

You are simply renting the car from the bank, who is the legal owner. FWIW, many captive banks are starting to take this position.

When you buy and finance, your name is on the title, with the bank as the lienholder, so you have the right to sell it, so long as the loan is paid off and the title can be transferred, free and clear.

Here's the thing - this whole situation is borne from this crazy market, where the market value is much higher than the buyout. Once things return to normal, and when most leases are "upside down", we won't likely see this provision maintained. My .02.

You'll likely have to buy the car first, then you can resell it for the higher value. Of course, you'll have to pay sales tax on the purchase, which would cut into any expected profit.
