It is like Drivers rule in business. I try to be as honest as possible in business, Then I found out liars and conmen can take advantage of you when you are too honest. So, I made a corollary, that says, always be honest, but when dealing with liars and thieves, you can use the same tactics they do.
That reminds me about my claim with UPS for damage of a poorly packaged shipment I got from a friend. The claim is languishing because they send it to the originating store (a UPS store). There has been no response from the store that did the boxing up to ship the item and the parent company is just letting the complaint lie there. I'd think 30 days is long enough for the store to think it over.
All I want is the portion of the charge for the packaging by the store that didn't properly box the item refunded to me.
It's time to get more firm and see if there's a method of written communication. I expected UPS to have a better system than what I've seen for 3 months. Other than the packing ability at the UPS Stores that FedEx doesn't have I can take things to Staples and they'll box and ship by FedEx for me. And there's USPS as well.
Is there a customer service department? In poorly run companies they are just the first line of defense. If that doesn't help you will have to try to contact someone higher up in the company, though I can almost guaranty, you will spend more time on the phone than what it is worth......unless you are like me and want to fight on principle.
Judge Judy is just arbitration disguised as a court room. The awards are paid by the show as are the travel expenses of the "litigants." The maximum award is $5,000.

That makes me think he treated my wife and I with contempt because of this attitude - poor truck driver could lose his livelihood vs guy in Mercedes.
I just went through a homeowners claim on a hail damaged roof (common here in North Texas) and I was really surprised at how smoothly it went. No hassles, fair payout (replacement value for new roof & gutters less my deductible), and no games played. I was prepared for the worst, but it went great. Very thankful. Totally opposite of Driver's experience. To keep on topic, the adjuster drove a Ford Transit Connect and he said it was a perfect vehicle for this type of work.
Driver, I suspect that a lot of your problem is that agent leaving. These companies are big, messy operations, and if a file is assigned to someone that stops working on it, can take a while before anyone else will. So hopefully your email and agent finally got someone competent looking at it.
absolutely ridiculous that it has been going on this long. eventually someone high enough up has to have it escalated to. and it really is such a simple thing to resolve once the right person looks at it. 2 minutes, stamp approved, and move on.

If I'm an adjuster earning interest on $2,600 for an average of 90 days longer than the best insurance company, multiplied by thousands of claims, that's a lot of black ink. But the truth is it's not $2,600. By low-balling the claim, they know they are delaying the entire claim for someone intent on being treated fairly. It's not like the insurance company says "Here you go, here's 90% of your claim amount up front since only 10% is in dispute." Nope, they delay the whole claim, so it really is interest/earnings on $65K+??? for however many days they can delay it, multiplied by a factor for however many claims they have open at any given time.

I think what Driver has noticed and what that lady said is true. It is part of why I have some contempt for law enforcement on the roadways of America. Usually when you get pulled over, the officer already has some contempt or disdain for the person they are pulling over because going 15 over somehow offends them.

many of them are just poorly organized, badly managed, and understaffed.
what looks from a customer standpoint as an orchestrated campaign to screw them, is quite often just incompetence. Still sucks to have to deal with it.
I think if that was more often the case you'd hear about more stories where people say they got overpaid on their claim. After all, incompetence should screw both the customer and the insurance company the incompetents work for equally frequently.
I do think my brother-in-law got overpaid for his Nissan Altima when it was totaled, but not significantly enough to think of it as a windfall.
Also, I've seen incompetence first hand at insurance companies. The problem is they don't like to admit or pay for their own mistakes. They'd rather refund a tiny bit of premium than pay the claim after the fact.
As for copying the Insurance Commissioner, it does a few things:
1) It does get their attention, but it also seems to piss them off and be combative towards you.
2) The Commissioners have no teeth to do anything, but the Companies still don't like being reported.
I know at least one insurance company manager said "I was trying to screw them." Sounds like they take it personally and emotionally too based on that line. I pointed out they were the ones trying to screw me, and that I was the victim in the case (suffered the loss through no fault of my own).

I've heard UPS or Fedex Warranty claims on shipping damage are a nightmare. In the few times where I encountered something that arrived damaged, none of the vendors seemed to want to deal with or take it out on the shipper; they just eat it.
I think it was a UPS Store manager that told me if the box doesn't arrive extremely mangled on the outside, you might as well not even try to file a claim.

I am certain it is true. Just imagine if the resources used to bravely fight simple speed offenses were used to combat distracted and inconsiderate driving. Make not using a signal or goofing around on a phone as much of a crime as being a violent scofflaw going 71 in a 60. Things would change a lot more than they have via the speedtrap mentality. Of course, it wouldn't create the same revenue stream, and that's a big part of the force behind it.
I also agree regarding those with an endless stream of at-fault accidents. One goof-up shouldn't be a game-ender, but someone who is causing expensive problems endlessly should be treated more seriously than others.

Last Saturday we toured the new D.O. medical school that just started in Las Cruces and they had a big seminar room full of "massage" tables for learning "manipulation". My wife keeps insisting that D.O.s are just like M.D.s but I'm not convinced.
When I lived out in a rural area from '87 to '99, there was only one doctor. It was actually several years before I even noticed that he was a D.O. rather than an M.D. He was just "the doctor", and actually a very good one. He opened up his office for me on a Sunday afternoon, and put a dozen stitches in my leg (don't ask). Which saved me from driving 25 miles to the nearest emergency room, and spending hours waiting around to see a doctor.
He's retired now, but he was the quintessential country doctor. If you said anything bad about him in that town, they probably would have lynched you.

I would have thought that USPS would be the way to make something disappear without a trace.
Actually all of those delivery firms have come a long way. The other day I was cleaning out a desk drawer and in the very back under something else was a piece of paper from Canada Post. About 20 years ago I bought (supposedly) a set of golf clubs from someone in the Carolinas - MacGregor JNP irons, fairly rare even then. I think they were $250, used. I sent a money order and the guy sent me an email saying he had shipped them USPS. They never arrived.
I contacted the guy and he was able to give me a number off the slip he received went he sent them. I took it to the post office here and they started a trace, which is what the piece of paper I found was proof of supposedly. Never heard another word from anyone. Today with online tracking you could see where the process broke down if nothing else. And no, I never got my money returned either.
Asked for directions to a trailhead this morning from a maintenance worker at the campground. She was in an official California state park pickup. When she stopped she smiled and went into contortions. When she got the window down, I said "crank windows eh?". She said every truck they have uses cranks, even the brand new ones.
That's when I noticed that her left arm was in a sling and she really had to go through contortions to talk to us. I think I would have just opened the door.
About a week ago we had a road rage incident in the KC area. One of the drivers, a young woman, was shot and killed by the other driver. Just passed her and shot her and kept going. The guy was captured within a few days and the police described how he was caught so fast: His father came forward and said the description of the vehicle he was driving sounded like his son's 2004 Toyota SUV, and said that his son was somewhat unbalanced. He had just purchased the SUV.
The police went to the dealership and were able, some way, to track the truck to a motel, 700 miles away in South Dakota, and the man was immediately taken into custody. I am assuming that they used GPS in some way to find him, but I did not know this was possible. Does this mean that anyone or any vehicle can to located like this? This was an older vehicle that probably did not have a navigation system.
I know many BHPH style lots put GPS trackers on vehicles to ease in repo. I doubt the stone-age Playskool quality ICE that would be in a 2004 Toyota SUV would enable such tracking.

Funny, up here, the UPS guy has drop-and-dash down to an art. I had several UPS deliveries this summer and I cannot get to the door quick enough to actually find him on the stoop. One knock, drop the box, and sprint back to the big brown truck. Once I got a wave out of him when I got to the door quickly, but that was it.

I had the same positive experience with my insurer. I had minimal ice dam roof damage but got a new roof out of it with money left over for whole house interior paint job. I can't complain except the roofer did not complete the job.

I like the GPS tracker for repo better. Cops said they went by the dealership where he bought the car and got some help. Plus the article mentioned the perp lived off the grid as much as possible. He had a few thousand dollars in silver coins with him.

@jmonroe, You and your family buy a lot of vehicles out of state. How do you get to drive them back home?
I'm not really sure what you mean but if it concerns taxes and plates transfers I have never had a problem. The dealership provides a temporary plate and off I go.
When I have bought in Ohio, they put on a temporary OH plate and when I got back to PA, I had 60 days to pay the PA taxes and the PA transfer fee of the old plate to the new car. When I bought in VA (the '15 Genny) the dealer put on a temporary VA plate and collected the PA tax and when I got home all I had to do was pay the PA plate transfer fee of the old plate to the new car. I have done all of this at the local AAA.

I agree. What concerns me is the truck driver had a problem, and he could really hurt somebody one day. His mistake wasn't an accident, he was in a hurry and driving beyond his capability.

How obnoxious people are on the road. Goofy people, all many of 'em. Hate ta have ta do their taxes - it would be like pullin' teeth.
And most of them are not Seahawk's fans, either - that's the worst part, sports fans!
If your going to choose a topic, the people around here can't get enough on your views on speed limits, and how they are enforced.
OK, that's a joke, I think everyone was worn out on those topics.
I'll say this, andres3 - I do enjoy getting the '11 Soul zipping a little faster now and a then. And I love it when people are harmonious on roads, including freeway travel. Fast is safer now than fast was in 1978, when I bought my first car, a 1965 Mustang.

How old do you have to be before you start living each day like it's your last? Easier said then done of course.
It makes getting a dashcam that much more attractive.
If I'm an adjuster earning interest on $2,600 for an average of 90 days longer than the best insurance company, multiplied by thousands of claims, that's a lot of black ink. But the truth is it's not $2,600. By low-balling the claim, they know they are delaying the entire claim for someone intent on being treated fairly. It's not like the insurance company says "Here you go, here's 90% of your claim amount up front since only 10% is in dispute." Nope, they delay the whole claim, so it really is interest/earnings on $65K+??? for however many days they can delay it, multiplied by a factor for however many claims they have open at any given time.
Yet the people actually causing accidents and wrecks (and traffic) doesn't seem to offend them at all. Backwards if you ask me!!!
I will say, sometimes the fact that an accident occurred is punishment enough though. I could see being lenient when I know someone will be charged as at-fault in an accident (at least if they had no prior accidents). Not sure piling on tickets is necessary in that case. If someone has caused multiple accidents in less than 3 years they should have the book thrown at them. I think causing extra congestion during rush hour by causing a wreck during that time should be punished extra severely.
I do think my brother-in-law got overpaid for his Nissan Altima when it was totaled, but not significantly enough to think of it as a windfall.
Also, I've seen incompetence first hand at insurance companies. The problem is they don't like to admit or pay for their own mistakes. They'd rather refund a tiny bit of premium than pay the claim after the fact.
As for copying the Insurance Commissioner, it does a few things:
1) It does get their attention, but it also seems to piss them off and be combative towards you.
2) The Commissioners have no teeth to do anything, but the Companies still don't like being reported.
I know at least one insurance company manager said "I was trying to screw them." Sounds like they take it personally and emotionally too based on that line. I pointed out they were the ones trying to screw me, and that I was the victim in the case (suffered the loss through no fault of my own).
I think it was a UPS Store manager that told me if the box doesn't arrive extremely mangled on the outside, you might as well not even try to file a claim.
I also agree regarding those with an endless stream of at-fault accidents. One goof-up shouldn't be a game-ender, but someone who is causing expensive problems endlessly should be treated more seriously than others.
He's retired now, but he was the quintessential country doctor. If you said anything bad about him in that town, they probably would have lynched you.
I checked the invoice and it is actually $3900, Tech Pkge is still $2600.
If the insurance comapny just gave me what I wanted they would have saved $900.

Actually all of those delivery firms have come a long way. The other day I was cleaning out a desk drawer and in the very back under something else was a piece of paper from Canada Post. About 20 years ago I bought (supposedly) a set of golf clubs from someone in the Carolinas - MacGregor JNP irons, fairly rare even then. I think they were $250, used. I sent a money order and the guy sent me an email saying he had shipped them USPS. They never arrived.
I contacted the guy and he was able to give me a number off the slip he received went he sent them. I took it to the post office here and they started a trace, which is what the piece of paper I found was proof of supposedly. Never heard another word from anyone. Today with online tracking you could see where the process broke down if nothing else. And no, I never got my money returned either.

That's when I noticed that her left arm was in a sling and she really had to go through contortions to talk to us. I think I would have just opened the door.
The police went to the dealership and were able, some way, to track the truck to a motel, 700 miles away in South Dakota, and the man was immediately taken into custody. I am assuming that they used GPS in some way to find him, but I did not know this was possible. Does this mean that anyone or any vehicle can to located like this? This was an older vehicle that probably did not have a navigation system.

I like the GPS tracker for repo better. Cops said they went by the dealership where he bought the car and got some help. Plus the article mentioned the perp lived off the grid as much as possible. He had a few thousand dollars in silver coins with him.

I still think this is backwards/backwoods thinking on the cop's part. To me this attitude reflects a "chaste-system" law enforcement mentality. The truckdriver needs a $1,000 "distracted driving" ticket that must be paid in full. No courtroom dickering allowed with this guy. Seriously.

When I have bought in Ohio, they put on a temporary OH plate and when I got back to PA, I had 60 days to pay the PA taxes and the PA transfer fee of the old plate to the new car. When I bought in VA (the '15 Genny) the dealer put on a temporary VA plate and collected the PA tax and when I got home all I had to do was pay the PA plate transfer fee of the old plate to the new car. I have done all of this at the local AAA.

I agree. What concerns me is the truck driver had a problem, and he could really hurt somebody one day. His mistake wasn't an accident, he was in a hurry and driving beyond his capability.
