I could never understand that. We talk just like the news announcers on NBC, CBS, ABC (Peter Jennings was Canadian)CNN, FOX etc. They don't have Brooklyn accents - Deez wise guyz was found 20 feet unda da wadder with cement shoooz, or say "Hows about fixin up some grub, hon". They don't say "warsh" instead of "wash" like in Minnesota. They don't have New England or Texan accents - "Good evenin' y'all", they speak the same way we do.
...thus far. I left a voice mail for my patio door salesman about 1-2 weeks ago with a counter offer. Didn't hear a thing from him till about an hour ago. He left a message on my answering machine., Just said he checked his messages and must have missed seeing the message I left him. hmmmm.
He apologised for not getting back with me sooner, and wants me to give him a call. I'll probably give him a call. Looking for a grand off his last offer, which I think is extremely fair and probably quite generous in the big cosmic picture of it all.
I was over at my sister's today for a birthday party. Hoping to put the final nail in the coffin in my daughters wanting a new car (for her 16th birthday) theory, I ask my sister what age her kids got their first car. Thinking they didn't get their cars till 17 or 18 years old, I asked my sister the question in front of my daughter, wife and relatives. My sister's answer? "When they turned 16."
Ouch! What a blunder. I'll have to put on my backtracking shoes (probably hush puppies) to get out of this one.
Is there any advantage for you if she does get a car? My kids got a 'ride' to drive to school because they had to be at school before the bus could get them there or had off school grounds sports participation. We didn't have to juggle our work schedules, so it was a benefit for us. There were a few bumps (literally)along the way.

Both of mine got cars as soon as they got their license. They were both involved in sports/other activities after school, and both had part time jobs. Saved us a lot of running around playing taxi service. They were both very responsible with good grades, or things might have been different.
we got a spare car for my son when he was close to 17, so he would have a AT car to practice on (was not comfortable with my stick car, and had little access to the van).
once he turned 17 and passed the drivers test, he had that one to use. Like others said, it saved me a ton of running around taking him places. especially nice when he was on a (school) band trip and got back in after midnight!
came with a restrictions list, and 1 at fault accident and it would have disappeared. he was also a good kid and good student, so pretty much "earned" it.
But jip, if you think it is too early, just say so and don't buy it. So she makes a drama out of it. I have a teenage girl. they make drama out of everything!
16 to me seems too young to be driving solo. 17 was scary enough.
My son was supposed to take the 2002 slushbox I bought off eBay, but he doesn't high geared manual steering. So now he wants to drive the Wrangler. I drove a Bronco V8 when I was his age, and the Jeep drives like a Mercedes SL compared to that. I just have to teach him how to drive a manual. I've signed him up for the two day teen school at the BMW Performance Center in SC, so at least he's getting off to a decent start.

My two that are driving have pretty much had use of a car from day one - again, the beats hauling them all over creation story.
Each got a dent in the van - one was rear ended and the other happened when it was parked.
My oldest drowned a 99 Camry when she misjudged the depth of a lake disguised as a puddle. I did question how someone who has never lived more than 5 miles from the ocean could not grasp the concept of tides but what are you going to do?

Law in Ky is my daughter would drive 6 months with adult lisenced driver, then could go solo. I think she's too young to have her own car. Driving my parents car when I was her age was good enough for me... and I had to be "extra" careful because it wasn't my car.
It sure would save me a lot of running though... school twice a day, field hockey practice, trips to the Mall. She could run errands for us and take her brother to his activities once in awhile.
Still, I think I'm going to push for her turning 17 years old before getting her own car. I should have a new patio door around that time, so you guys will be able to feast on 2 sales stories. :P
Jersey rules are they can get a permit at 16, but can't go solo until they are 17. So you get plenty of time to tutor them. I did find it handy to get the car they would be driving during the probationary period, so you both had time to get used to it!
my 15 YO daughter loves to tell me how many days it is until she turns 16 and can start (and we are down to less than 9 months now). Such fun. Can't wait. though at this point, no money in the budget for a 4th set of wheels so she may have to fight her brother in college for his (unless gas prices and other expenses force a reduction to 2!)

Do what my parents did, tell her she can get a car whenever she wants as long as she pays for it. I may have been driving a 10 year old rust bucket to school but it was paid for out of my hard earned money.
Here is another ideal for you, I had a coworker install one of those dash cameras on his car. The deal was that if the kid wanted to drive the car the camera had to be on and recording. That way he could check how the kid was driving. One day some idiot did a right turn on red right infront of his daughter and she rear eneded him, the guy claimed he didn't make a turn and he was already on the street. The camera turned a he said/she said into a he said/dash camera said.

You don't have to put them on your insurance during the permit period.. not until they get their restricted license at 16 1/2.
Just six months later, at 17, they are in a higher rating category. The insurance on my son's car just dropped from $1350 to $1160!
The good student discount through my insurance company is over 20%! Without it, $1500 vs. $1160. ----------------------------------------------------
My wife grew up on a farm... she has 4 siblings... they all got beaters to drive, as soon as they got their license, because they were so far from everything they needed to do.. I didn't get a car until I was a year out of high school. We live in an inner-ring suburb... Everything is close. I told my wife that I wasn't getting my son a car.. We don't have school bus service, but I'd been taking him to school for 10 years, and two more wouldn't kill me..
So... my uncle offers to give him my late aunt's car, and then he signs up for an "early-bird" AP class that starts at 7:00 AM.. Now, the car doesn't seem like such a bad idea.
We've had some typical teen-age issues, that normally might make me take away the use of the car... but, then I'd have to get up an hour earlier... So, we have to use other means of discipline.. :P

Smart....we learned that in Teacher's College...don't give out a penalty that makes it worse for you. For example, don't make a kid stay after school for an hour, if you have to watch them for an hour, when you could have gone home.
Some parents say, we won't visit Auntie Jane unless you get dressed nicely. The kid doesn't want to see Auntie Jane any way, and you will prevented from going to see Jane, all because of a poorly thought out penalty.

I don't know what your problem is with getting her a car. There are tons of young unemployed guys hanging out on every street corner just looking for young girls to give them a ride. She'll be very popular. :shades:

I have a neighbor who has a Chevrolet Higlander. He took it back to the dealer under warranty to fix something....he doesn't remember what it was that he asked them to fix.
He claims they didn't fix it, so the next time he left the car at the service department he made a mark on the tire. When he came back later that day he saw that the car had not been moved, the mark was in exactly the same spot.
He went in and they said they worked on the car and did $150 worth of work, which was covered by the warranty.
He is the kind of customer no business would want. He took several years before he finally bought the car...driving the sales people crazy, and his hobby is writing nasty letters to companies and complaining about everything....not on a computer but by letter and telephone calls.
These people are multi-millionaires and can buy any car they want, but they will only buy Chevs. He is in the hospital now for surgery and he won't pay the $15 a week to have a TV, and his wife said she brought him some magazines to read.....they were all freebies like AAA magazine! They love reading the newspaper, but only if we give them ours after we have read them.
The dealer probably was wrong to not even look at his car, but then again, I guess there is only so much you can do.
My first question is what was wrong with the car? It is possible that the issue was minor and might have been able to be performed without moving the car. $150 warranty repair does sound like a quick fix if there were parts required. It's not likely to happen but if you have a troublesome customer like that the service manager might have sent a mechanic out just to check it before brining it in.

That is very possible. I did ask what the problem was and he said he couldn't remember the actual problem. He has taken the car back numerous times for faulty sensors and a few other problems. I think they just thought if they told him they looked at it and repaired it he would go away.
I had to get a sensor replace once, it was an O2 sensor along the air intake. My mechanic changed it in a few minutes out in the parking lot. IIRC it would have taken him longer to pull the car into the bay then bring it out again after he was done.

That quite possible is the way it went....I don't know for sure, but it makes sense. These people are very eccentric (at Christmas time they go around the house with reindeer pajamas and with antlers on - and they have an electric train that goes around a Xmas tree that shoots snow come out of the top of the tree), so they could just feel nothing was being done.

When I was teaching, I never minded keeping my students after school for an hour. I used the time to grade papers, do lesson plans, put work for the next day on the board, etc. I never left right after school like some. I enjoyed the quiet time to get things done. The only catch was meetings. I would have to set dates for detention around department and committee meetings.
Another good thing about keeping students after school was the one-on-one time. It gave us a chance to visit and discuss the problems. That often prevented future infractions. In later years, bus schedules became a problem. We were not allowed to be the cause of a student missing the bus. In the old days, you could carry them home in your car. Liability issues and being alone with a student later put a stop to that option. When I first started teaching, we were required to makie home visits twice a year. As time went by, this option became too dangerous. It's a shame. It was a great way to meet parents and ward off problems. Still, I would visit their place of business if I had a need. That certainly put a stop to some unwanted behaviors. You just had to be creative and consistent.
I was left out of my mother's trust because we had basically no relationship for the last 15 years of her life. Having greedy siblings in the mix also pushed her in that direction. I came from a very dysfunctional family where $ was their G-d & since I didn't march lockstep with them, I (We) were all cut out. In Florida that is legal. The funny part is when she died, a family trust from my dad's will kicked in which I'm a 1/4 beneficiary of. I found out that they tried to steal my part of an annuity, which once caught, was added back into the trust. Still no resolution since my mother died in the end of December 2005. So the money sits in a brokerage account with no executor, as he quit & wanted nothing to do with my crazy siblings.
Now, we owe back taxes which the older brother is working with the IRS to lower them because the lack of an "official" executor though he has taken on that role "unofficially". Very confusing & "their" lawyer won't talk with me on any level when I question him. So here we sit, while my brother is dying of pancreatic & liver cancer...in this holding pattern. Not sure what to do next as the oldest sibling has since died & my twin had a special provision set up for him due to some mental issues years back. If my older bro dies, I'll have to step in & hire a new attorney to set things straight. They've turned a very simple trust into a nightmare & there's not much communication going on. What can I do if he actually does die? I'm the only one who had no separate provisions stipulated & I've already signed off to give the twin his full share when all is divided up since I didn't want to be the trustee for his 1/4 share. I want this done so we can all move on & say good bye since we're no longer a "family"...just bound by a contract here.
What options do I have?

Yikes! I am suddenly happy that no one left a trust for me - well, other than Richard....
Biggest issue in the family is my folks house. We've been renting out to trusted folks. One brother wants it sold ASAP but the rest of us are fine taking our time figuring that it's at the bottom of the market now and besides, if it is still there when I turn 62 I might sell here and buy it.

It's such a shame that "legal" issues stop teacher from being that friendly adult who can change a kid's life. A few evil adults and a few evil lawyers have prevented that.
Male staff in particular have to be wary of false accusations. As a bus driver little kids will want to hug me or sit on my lap. I have to push them away and firmly state "don't touch the bus driver" because of the chance of someone making a false accusation. it makes me sad to see the looks on their little faces.
I was on a field trip with the girl's tennis team once when several girls came back on the bus and started changing their clothes. I had to tell them to knock it off and make them walk 1/4 mile back into the school to change just in case someone were to drive by and see the girls changing in the back of the bus. When I asked the 20 something coach to talk to the girls about this she laughed and gave me eye roll that young people do when us older folks are being uncool.
I bet she would have been the first to call the cops if one of the girls had accused me of anything.

I feel very sorry for you. Nothing is more painful after a death of a loved one than to see a bunch of greedy vipers act badly. The simplest thing , if you don't need the money yourself, is to walk away and let them eat each other. Try to avoid the temptation to "beat" them at this game they're playing. No amount of money will be worth the pain it will cause you.
I was lucky, when my mother died I was named her executor. I knew that my brothers had borrowed substantial sums from my parents and had never paid most of it back. My mother's will said that unpaid loans were to be deducted from each brothers share and split three ways. This would have given me quite a bit more than I otherwise would have received. It would also have caused some resentment among my less responsible brothers.
In the end I took them aside and simply said :"As of right now all debts are canceled for all of us". We all agreed to take equal shares from there.
I lost my mother but I now have a closer relationship with my brothers.

You remind me of a funny thing that happened a bunch of years ago. I get a call from my dad - at work yet - and he's complaining about his sons borrowing money from him and not repaying and how he's going to make a list and have these deducted from the miscreants' shares in the will. I ask, "Dad, what on earth do I owe you?" He replies, "Oh, you aren't one that borrows. It's your brothers." "So you're calling me.".....
Well, as it turns out he left little but the house anyway and for the most part I think the brothers made up whatever the amount might have been in taking care of him in his last years. At any rate I'm not worried about it.

I have a story that could be an important one when making wills. We are still working on ours, but this story really made us think things over.
My wife has an Aunt, we will call Betsy. Betsy's husband died, and of course Betsy now had all the money and possesions. It was a fairly large amount.
Well, Betsy married again, within a year.
So, far so good.
However, Betsy became very ill and she died fairly soon after marrying husband #2.
Betsy's husband got everything, and didn't give any to the 3 children....which I am sure is not what Betsy and her first husband would have wanted.
So, I said to my wife, who assures me she would never marry again if I go, that we never know what happens in life. We can make promises now, and I am sure we mean them, but, what happens if I go and she meets some hunky 24 year old boytoy and gets sweet talked into something :sick:
So, now in our wills...if either of us dies first, all the children at that time get an inheritance amount at that time. Not all, because the survivor has to live.....just don't want her living too well, if you know what I mean.
My will says if I go she has to sell my BMW and cannot give it any boyfriends (Naw, I made up that part).
Believe me, I do feel your pain. I have grown so waery of these complicated estates and Wills done by others. As of this past Thursday, we are now paying rent on a warehouse to store my wife's cousin's house contents---extensive colloections of paintings, clocks, silver, furniture, etc. We've had to line up appraisers and dealers to get rid of it all. By the time that we pay appraisers and dealers, who knows what will be realized as proceeds. It's been stressful and time consuming. We just want it over with soon. Some well intended gifts turn out to be burdens.
On top of that, an aunt left my wife and her evil brother farm land. He is the executor of the estate---four years now. Instead of closing the estate, he keeps it open so that he can pay himself "fees" each time a plot of land is sold. We've had to hire an attorney to make him close the estate. This cost money. Her brother is so into the power mode---and greedy as hell. He even made the aunt change her Will to leave his wife part of my wife's part. People will kill you for less than 50 cents! What a mess.
Wish I had an answer for you. You could hire your own attorney, but it will cost you. Our attorney is $175 per hour. We had to get rid of the one who was charging us $325 an hour. Perhaps you should just wait a year or two. Maybe things will straighten themselves out by then. I hope so for your sake. As someone said earlier, it may be better to just walk away from all of it. Life is too short to be constantly stressed out by such matters. We have to be careful, less we get what we asked for at times.
You are very smart to think about the children in case your wife gets married again. My wife's father divorced her mother and married his secretary. When he died in 2008 at age 95, his young wife got three million. My wife got $50K. Seems a bit lopsided to me.
I want this done so we can all move on & say good bye since we're no longer a "family"
Sandman, that is a really sad story, but, unfortunately, when wills are settled, the nastiness of some people really comes to the surface.
I know little about legal issues and less about wills, but it might be worth having a paqralegal or lawyer who works cheaply find out why things aren't advancing. It doesn't sound like anything is holding up getting things going, just roadblocks that a determined basic lawyer or paralegal can get through.
The lawyer who does our wills works for about $100 an hour to do a will, he is retired and does legal work a few hours a day, just to keep busy. His office is in part of an old warehouse and he has model airplanes hanging from the ceiling. I can tell he is an excellent lawyer especially for wills, he knows all the problems and asks the right questions.
I hope you get this resolved but don't let it get to you, it will wear you down. If you come out of this with anything, it will be a bonus....and the real bonus will be you will be free of your siblings.

We bought a very nice house 2 houses ago at a very good price. The owner was 84 years old, and he was renting the house to his adult children who had older teens still living at home.
The owner got a 30 year old girlfriend who insisted that they get a condo in Florida.
He wanted to sell the house to get the money to buy the condo. The children in the house were upset that the rug was being pulled out from under them....but it worked out well for us, we bought at way below market value.
I sometimes wonder how the 84 year old guy made out with his young girlfriend. Maybe we should see if that condo is available for sale?

I’m sure all of us at one time or another told/threatened our kids that if they acted up they would be punished. Like, “if you do that again, we’re not going to Well, one time we had to make good on that comment. We were going to meet a few parents of our sons about a school project that both of them had and then go to dinner. We said something like, “if you do that again we’re not going”. They did it but because of what was involved they didn’t think we’d follow through. Surprise !! We called the parents to apologize and told them what was going on and we stayed home.
I increased the punishment by not allowing them to go to a school dance after a football game and I nixed the game too. Son #2 said you didn’t say anything like that when you told us not do “that” (I don’t remember what “that” was). I said, “I’m not that smart. I can’t think of everything at the same time”. :surprise:
Yes, when you say something you have to be prepared to follow through with what was said.
We never had that problem again. They just couldn’t trust me to get it right the first time.

Beaut-f-u-l! The kids thought you would never pull out of the meeting....but you did! Too many parents don't follow through. I have seen a parent say, if you don't stop acting up we won't be going to the amusement park. The kid is still acting up, but the parents don't want to ruin the day for every one, so they go to the park. What does that teach! It just reinforces the parents are hopeless and the kids can do what they want to do, without a penalty.
People will kill you for less than 50 cents! What a mess.
I’ll take your word for it because I’m so fortunate that we didn’t have problems when my Mother died.
There was a little money to be divvied up but not much. I’ll never forget the great compliment my brothers and I had paid to us by the lawyer who wrote our Mothers Will.
The lawyer read her Will and said that he told Mom that the money was the easy part but it was the remaining possessions that are usually the problem and suggested some words in the Will to set that straight. Mom said, “oh, that sounds like such legalize, I don’t want to put that in. So, just leave it like this” (as she wanted the wording). I remember the lawyer saying that he almost pleaded with her to allow him to change the wording but she insisted saying something like, “oh, don’t worry about that. My boys (3 of us) will know how to handle that”.
After the reading and everything was agreed to he said, “boy, your Mother sure did know her sons. That’s exactly the way she said you’d handle this. That is very uncommon with these things”.

Saw a new Elantra last nite in white...stunning, even wifey liked it. Think it will be her next car in 2012...the Mazda is running great since they got rid of the error code. Even that leak in my Civic has stopped...yay!! Looked at the odo this morning, have only put on 400 miles since mid October when work sent me home. At this rate, won't even put 1000 miles this year. It's at 31760 now so I'll have this puppy for a long time. But better to save the $ at this point. Told my wife last nite after the Elantra siting that Hyundai is becoming the Honda of the 90's at this point, each car gets better & better...I'd buy one for me next time I purchase & will steer the boy in that direction too since his funds are limited. Wifey has decided to just pay off his student loans without him knowing & leave him with only 15k for him to pay. Luckily his job at AmeriCorps will pay 5k/year!

No way that I'm walking away from it...my dad wanted us to have it & it'll be for my retirement. Sad situation but know it'll work out...I've got patience & can wait. Thinking the older dying brother is going to want his share before he goes so we'll just wait. Just isn't fair to "walk away" since it's only a "contract" to me anyways...there's no family ties involved...just a legal contract.
Appreciate the advice from y'all & will let time figure things out...may not be a lot of $, but my dad wanted us to have it. Trust me, if he hadn't died 1st, this would never have happened. He was a "cheap s. o. b., but he was fair"!

This hasn't been an issue for me but only because I have no rich relatives with no one to leave the money to.
The lawyer dealing with dad's estate is my brother. I trust him completely but it will drag along. Could be worse. I could have gone to law school. Then it would never get done.
Of course when driver leaves me his BMW that could be a burden but I am willing to take that chance.

Why not use the "Well, if they jumped off a building does it mean you have to jump off of a building" arguement.

once he turned 17 and passed the drivers test, he had that one to use. Like others said, it saved me a ton of running around taking him places. especially nice when he was on a (school) band trip and got back in after midnight!
came with a restrictions list, and 1 at fault accident and it would have disappeared. he was also a good kid and good student, so pretty much "earned" it.
But jip, if you think it is too early, just say so and don't buy it. So she makes a drama out of it. I have a teenage girl. they make drama out of everything!
16 to me seems too young to be driving solo. 17 was scary enough.

Each got a dent in the van - one was rear ended and the other happened when it was parked.
My oldest drowned a 99 Camry when she misjudged the depth of a lake disguised as a puddle. I did question how someone who has never lived more than 5 miles from the ocean could not grasp the concept of tides but what are you going to do?
It sure would save me a lot of running though... school twice a day, field hockey practice, trips to the Mall. She could run errands for us and take her brother to his activities once in awhile.
Still, I think I'm going to push for her turning 17 years old before getting her own car. I should have a new patio door around that time, so you guys will be able to feast on 2 sales stories. :P
my 15 YO daughter loves to tell me how many days it is until she turns 16 and can start (and we are down to less than 9 months now). Such fun. Can't wait. though at this point, no money in the budget for a 4th set of wheels so she may have to fight her brother in college for his (unless gas prices and other expenses force a reduction to 2!)

Do what my parents did, tell her she can get a car whenever she wants as long as she pays for it. I may have been driving a 10 year old rust bucket to school but it was paid for out of my hard earned money.
Here is another ideal for you, I had a coworker install one of those dash cameras on his car. The deal was that if the kid wanted to drive the car the camera had to be on and recording. That way he could check how the kid was driving. One day some idiot did a right turn on red right infront of his daughter and she rear eneded him, the guy claimed he didn't make a turn and he was already on the street. The camera turned a he said/she said into a he said/dash camera said.

You don't have to put them on your insurance during the permit period.. not until they get their restricted license at 16 1/2.
Just six months later, at 17, they are in a higher rating category. The insurance on my son's car just dropped from $1350 to $1160!
The good student discount through my insurance company is over 20%! Without it, $1500 vs. $1160.

My wife grew up on a farm... she has 4 siblings... they all got beaters to drive, as soon as they got their license, because they were so far from everything they needed to do.. I didn't get a car until I was a year out of high school. We live in an inner-ring suburb... Everything is close. I told my wife that I wasn't getting my son a car.. We don't have school bus service, but I'd been taking him to school for 10 years, and two more wouldn't kill me..
So... my uncle offers to give him my late aunt's car, and then he signs up for an "early-bird" AP class that starts at 7:00 AM.. Now, the car doesn't seem like such a bad idea.
We've had some typical teen-age issues, that normally might make me take away the use of the car... but, then I'd have to get up an hour earlier... So, we have to use other means of discipline.. :P

Smart....we learned that in Teacher's College...don't give out a penalty that makes it worse for you. For example, don't make a kid stay after school for an hour, if you have to watch them for an hour, when you could have gone home.
Some parents say, we won't visit Auntie Jane unless you get dressed nicely. The kid doesn't want to see Auntie Jane any way, and you will prevented from going to see Jane, all because of a poorly thought out penalty.

He claims they didn't fix it, so the next time he left the car at the service department he made a mark on the tire. When he came back later that day he saw that the car had not been moved, the mark was in exactly the same spot.
He went in and they said they worked on the car and did $150 worth of work, which was covered by the warranty.
He is the kind of customer no business would want. He took several years before he finally bought the car...driving the sales people crazy, and his hobby is writing nasty letters to companies and complaining about everything....not on a computer but by letter and telephone calls.
These people are multi-millionaires and can buy any car they want, but they will only buy Chevs. He is in the hospital now for surgery and he won't pay the $15 a week to have a TV, and his wife said she brought him some magazines to read.....they were all freebies like AAA magazine! They love reading the newspaper, but only if we give them ours after we have read them.
The dealer probably was wrong to not even look at his car, but then again, I guess there is only so much you can do.

That is very possible. I did ask what the problem was and he said he couldn't remember the actual problem. He has taken the car back numerous times for faulty sensors and a few other problems. I think they just thought if they told him they looked at it and repaired it he would go away.

That quite possible is the way it went....I don't know for sure, but it makes sense. These people are very eccentric (at Christmas time they go around the house with reindeer pajamas and with antlers on - and they have an electric train that goes around a Xmas tree that shoots snow come out of the top of the tree), so they could just feel nothing was being done.

When I was teaching, I never minded keeping my students after school for an hour. I used the time to grade papers, do lesson plans, put work for the next day on the board, etc. I never left right after school like some. I enjoyed the quiet time to get things done. The only catch was meetings. I would have to set dates for detention around department and committee meetings.
Another good thing about keeping students after school was the one-on-one time. It gave us a chance to visit and discuss the problems. That often prevented future infractions. In later years, bus schedules became a problem. We were not allowed to be the cause of a student missing the bus. In the old days, you could carry them home in your car. Liability issues and being alone with a student later put a stop to that option. When I first started teaching, we were required to makie home visits twice a year. As time went by, this option became too dangerous. It's a shame. It was a great way to meet parents and ward off problems. Still, I would visit their place of business if I had a need. That certainly put a stop to some unwanted behaviors. You just had to be creative and consistent.

Now, we owe back taxes which the older brother is working with the IRS to lower them because the lack of an "official" executor though he has taken on that role "unofficially". Very confusing & "their" lawyer won't talk with me on any level when I question him. So here we sit, while my brother is dying of pancreatic & liver cancer...in this holding pattern. Not sure what to do next as the oldest sibling has since died & my twin had a special provision set up for him due to some mental issues years back. If my older bro dies, I'll have to step in & hire a new attorney to set things straight. They've turned a very simple trust into a nightmare & there's not much communication going on. What can I do if he actually does die? I'm the only one who had no separate provisions stipulated & I've already signed off to give the twin his full share when all is divided up since I didn't want to be the trustee for his 1/4 share. I want this done so we can all move on & say good bye since we're no longer a "family"...just bound by a contract here.
What options do I have?

Biggest issue in the family is my folks house. We've been renting out to trusted folks. One brother wants it sold ASAP but the rest of us are fine taking our time figuring that it's at the bottom of the market now and besides, if it is still there when I turn 62 I might sell here and buy it.

It's such a shame that "legal" issues stop teacher from being that friendly adult who can change a kid's life. A few evil adults and a few evil lawyers have prevented that.
Male staff in particular have to be wary of false accusations. As a bus driver little kids will want to hug me or sit on my lap. I have to push them away and firmly state "don't touch the bus driver" because of the chance of someone making a false accusation. it makes me sad to see the looks on their little faces.
I was on a field trip with the girl's tennis team once when several girls came back on the bus and started changing their clothes. I had to tell them to knock it off and make them walk 1/4 mile back into the school to change just in case someone were to drive by and see the girls changing in the back of the bus. When I asked the 20 something coach to talk to the girls about this she laughed and gave me eye roll that young people do when us older folks are being uncool.
I bet she would have been the first to call the cops if one of the girls had accused me of anything.

I feel very sorry for you. Nothing is more painful after a death of a loved one than to see a bunch of greedy vipers act badly. The simplest thing , if you don't need the money yourself, is to walk away and let them eat each other. Try to avoid the temptation to "beat" them at this game they're playing. No amount of money will be worth the pain it will cause you.
I was lucky, when my mother died I was named her executor. I knew that my brothers had borrowed substantial sums from my parents and had never paid most of it back. My mother's will said that unpaid loans were to be deducted from each brothers share and split three ways. This would have given me quite a bit more than I otherwise would have received. It would also have caused some resentment among my less responsible brothers.
In the end I took them aside and simply said :"As of right now all debts are canceled for all of us". We all agreed to take equal shares from there.
I lost my mother but I now have a closer relationship with my brothers.

Well, as it turns out he left little but the house anyway and for the most part I think the brothers made up whatever the amount might have been in taking care of him in his last years. At any rate I'm not worried about it.
My wife has an Aunt, we will call Betsy. Betsy's husband died, and of course Betsy now had all the money and possesions. It was a fairly large amount.
Well, Betsy married again, within a year.
So, far so good.
However, Betsy became very ill and she died fairly soon after marrying husband #2.
Betsy's husband got everything, and didn't give any to the 3 children....which I am sure is not what Betsy and her first husband would have wanted.
So, I said to my wife, who assures me she would never marry again if I go, that we never know what happens in life. We can make promises now, and I am sure we mean them, but, what happens if I go and she meets some hunky 24 year old boytoy and gets sweet talked into something :sick:
So, now in our wills...if either of us dies first, all the children at that time get an inheritance amount at that time. Not all, because the survivor has to live.....just don't want her living too well, if you know what I mean.
My will says if I go she has to sell my BMW and cannot give it any boyfriends (Naw, I made up that part).

On top of that, an aunt left my wife and her evil brother farm land. He is the executor of the estate---four years now. Instead of closing the estate, he keeps it open so that he can pay himself "fees" each time a plot of land is sold. We've had to hire an attorney to make him close the estate. This cost money. Her brother is so into the power mode---and greedy as hell. He even made the aunt change her Will to leave his wife part of my wife's part. People will kill you for less than 50 cents! What a mess.
Wish I had an answer for you. You could hire your own attorney, but it will cost you. Our attorney is $175 per hour. We had to get rid of the one who was charging us $325 an hour. Perhaps you should just wait a year or two. Maybe things will straighten themselves out by then. I hope so for your sake. As someone said earlier, it may be better to just walk away from all of it. Life is too short to be constantly stressed out by such matters. We have to be careful, less we get what we asked for at times.

Sandman, that is a really sad story, but, unfortunately, when wills are settled, the nastiness of some people really comes to the surface.
I know little about legal issues and less about wills, but it might be worth having a paqralegal or lawyer who works cheaply find out why things aren't advancing. It doesn't sound like anything is holding up getting things going, just roadblocks that a determined basic lawyer or paralegal can get through.
The lawyer who does our wills works for about $100 an hour to do a will, he is retired and does legal work a few hours a day, just to keep busy. His office is in part of an old warehouse and he has model airplanes hanging from the ceiling. I can tell he is an excellent lawyer especially for wills, he knows all the problems and asks the right questions.
I hope you get this resolved but don't let it get to you, it will wear you down. If you come out of this with anything, it will be a bonus....and the real bonus will be you will be free of your siblings.

We bought a very nice house 2 houses ago at a very good price. The owner was 84 years old, and he was renting the house to his adult children who had older teens still living at home.
The owner got a 30 year old girlfriend who insisted that they get a condo in Florida.
He wanted to sell the house to get the money to buy the condo. The children in the house were upset that the rug was being pulled out from under them....but it worked out well for us, we bought at way below market value.
I sometimes wonder how the 84 year old guy made out with his young girlfriend. Maybe we should see if that condo is available for sale?

I’m sure all of us at one time or another told/threatened our kids that if they acted up they would be punished. Like, “if you do that again, we’re not going to Well, one time we had to make good on that comment. We were going to meet a few parents of our sons about a school project that both of them had and then go to dinner. We said something like, “if you do that again we’re not going”. They did it but because of what was involved they didn’t think we’d follow through. Surprise !! We called the parents to apologize and told them what was going on and we stayed home.
I increased the punishment by not allowing them to go to a school dance after a football game and I nixed the game too. Son #2 said you didn’t say anything like that when you told us not do “that” (I don’t remember what “that” was). I said, “I’m not that smart. I can’t think of everything at the same time”. :surprise:
Yes, when you say something you have to be prepared to follow through with what was said.
We never had that problem again. They just couldn’t trust me to get it right the first time.

Too many parents don't follow through. I have seen a parent say, if you don't stop acting up we won't be going to the amusement park. The kid is still acting up, but the parents don't want to ruin the day for every one, so they go to the park. What does that teach! It just reinforces the parents are hopeless and the kids can do what they want to do, without a penalty.

I’ll take your word for it because I’m so fortunate that we didn’t have problems when my Mother died.
There was a little money to be divvied up but not much. I’ll never forget the great compliment my brothers and I had paid to us by the lawyer who wrote our Mothers Will.
The lawyer read her Will and said that he told Mom that the money was the easy part but it was the remaining possessions that are usually the problem and suggested some words in the Will to set that straight. Mom said, “oh, that sounds like such legalize, I don’t want to put that in. So, just leave it like this” (as she wanted the wording). I remember the lawyer saying that he almost pleaded with her to allow him to change the wording but she insisted saying something like, “oh, don’t worry about that. My boys (3 of us) will know how to handle that”.
After the reading and everything was agreed to he said, “boy, your Mother sure did know her sons. That’s exactly the way she said you’d handle this. That is very uncommon with these things”.

Told my wife last nite after the Elantra siting that Hyundai is becoming the Honda of the 90's at this point, each car gets better & better...I'd buy one for me next time I purchase & will steer the boy in that direction too since his funds are limited. Wifey has decided to just pay off his student loans without him knowing & leave him with only 15k for him to pay. Luckily his job at AmeriCorps will pay 5k/year!

This hasn't been an issue for me but only because I have no rich relatives with no one to leave the money to.
The lawyer dealing with dad's estate is my brother. I trust him completely but it will drag along. Could be worse. I could have gone to law school. Then it would never get done.
Of course when driver leaves me his BMW that could be a burden but I am willing to take that chance.
