    LOL... More like a mind deal. You exxpect so much from your players that you put in and theones on the bench get all the points.

    i benched Brian Westbrook yesterday and he would have given me 38pts for the day. unbelieveable.

    To continue with that story:

    No one got lucky out of this one! ;) I ended up doing all the paperwork and put the customer out riding overnight so he could show the truck to the wife. Saturday I came in and after the sales meeting the receptionist hands me an early bird envelope with some keys in it. "What's up with this?" I asked. "Bon came over and told me to give them to you." Bon is a service writer, blonde with not much upstairs (literally and figuratively). I look inside the envelope and retrieved the keys and nothing else. "No note or anything?" I ask. "No." the recep responds. Hmm, very strange I think.
    So anyway, as my killer day continues and I get ready for my last appointment of the day (The Doctor was busy on Saturday!) :blush: I get a phone call. "Hey Mack, it's Dan." I hear on the other side of the line. "What's up Dan! Your truck is cleaned up and ready to go." I tell him. "Didn't you get my note?" he says. Here we go again. "No, no note." I respond. "I dropped the truck off this morning after I got out of work." he says, "after talking it over with my wife last night she convinced me we should get an 08 four wheel drive since we go to PA to visit my mother in law.." he continues. "Hey, that's fine. I don't have a black one coming in but I can get you one. Just let me know when you want it so I can preference one for you." I tell him. I get off the phone and go about my business for the rest of the day......
    THE DAY BEFORE....
    As I went into the sales office, Fred comes up to me and starts complaining about me taking "his customer". "Look, I didn't take your customer. He was with Jim since you left him alone in the showroom and you went with another customer. When he saw me he decided he wanted me to help him since he knows me and doesn't know either one of you." Fred gets upset and threatens to "kick my [non-permissible content removed], but won't because I'm an "old man". So I tell him, "I may be old but I can still kick your butt." :shades: He turns around and comes charging at me. :mad: One of the managers grabs him and tells him to cool down and go outside. He continues taunting me and says: "Come on, let's go outside." So I say to you. "Be my guest, I'll follow you." ;) and wink at him. "let my just finish this deal with "your customer"" This irritates him more and he goes around the desk to try and get to me from the other side. Both entries are blocked and finally he gives up and goes outside. I ignore him for the rest of the day and things finally calm down. The next day our GSM makes a joke about it but since he's late for the sales meeting he doesn't get to enjoy it.

    Joel said something about a peace of mind thing with Leases through Ford but that GMAC does not have a similar program. They might be stuck with the car after all.

    Thing is, the guy is dead. Nobody's name was on the lease except for him. There's no estate. Who is GMAC going to go after? My thought is that we'll drop it off and they'll work it like a voluntary repo. I don't see what else they could do.

    I believe you need to be asking your question to an estate lawyer. You say 'there is no estate', because he left his assets to his daughter and son, but in reality he leaves both assets and liabilities to his estate. Whoever is the executor of the estate, has to pay off the liabilities, pay estate taxes on the remaining assets, and then they are distributed to the beneficiaries.

    "IF" there were truely no assets, but just liabilities, then whoever the creditors are out of luck and they get their owned assets back. If on the other hand there are assets, then the creditors get first dibs on the assets to close out the liabilities. You need to be careful with 'gifts' (don't try to move assets to the beneficiaries), because there are gifting lookbacks that are reviewed. Uncle Sam wants his portion of estate taxes. If you moved them more than 3 years ago you're okay (5 yrs to a trust), but any gifts within the last 3 years will count as part of the estate.

    I'd suggest whoever the executor is get with a lawyer, and file all the necessary paperwork, tax forms, and notifications that have to get filed. There are discounts for filing quickly, so you'll want to be as prompt as possible if you can. He'll suggest the proper way to attempt to close out the lease. I've never had a lease as part of an "estate" that I've been involved with, so I personally don't know how they get handled.

    Very good advice. Just because one leaves things directly to someone or more than one person does not mean there is no estate. Indeed, it proves the existence of one.

    Some leases are like mortgages. They outlive the person who took them out.

    I suppose the question might become whose credit it wrecks if the lease is still valid and then goes into default. My first two guesses would be the daughter and the son - the heirs of the estate.

    Again, get a lawyer that deals in this kind of thing. There's "how I think it ought to work" and there's "how it actually works." They aren't necessarily the same thing.

    Y el segundo: As I mentioned in a previous post the Pats were 2-14 in my first year as a MA resident. I ain't forgot. Nor that they started 4-0 in Pete Carrolls first year and that led to not too much for the Pats. As to that distant past, enjoy livin'large in it! The present and future is all Pats, all the time! For now, at least... :D

    And thoidly: The Pats got caught doing the same thing (mere conjecture on my part. And most sportwriters/analysts/commentators) everyone else does. Yeah, getting caught has really shut down Brady, Moss, Welker, Maroney and the mighty O-Line!

    I’m curious as to the mood in Cincy with their horrible start? Are they being called the Bungals yet and are they calling for Marvin’s head since he’s considered (or at least was) a defensive guru?

    I personally think you have an organization problem and having more than you're share of hoodlums-in-cleats doesn't help the situation either. :cry:

    They’ll probably win but you have to play the season one game at a time. That’s real coach speak but it’s true. If for no other reason than injuries the Pats aren’t going 16-0 and NFL history also says it won’t happen.

    I remember when Belecheat was in Cleveland he wasn’t considered a genius then; more than likely because he was with a poor organization and didn’t have enough good players, the complete opposite to what he has now.

    We all seem to be car guys here so we should know just because a team has a very good driver, you ain’t going to win without the H.P. under the hood.

    I’m from the Burgh and the Steelers are 3-0 (lots of talk here) and the Pats are 3-0 so if some football god were to offer me either the Pats or the Steelers end of season record right now, all other things being equal, (like injuries as of right now) I’ll take the Pats, hands down. Remember that H.P. thing?

    OK, maybe now I have your attention. I posted a question 50 or 60 posts ago which is reproduced below. Either nobody wanted to take a shot at answering it or it just got lost. So assuming it was the latter, here it is again.

    Right now with the Canadian$/US$ exchange rate at or very close to par there is great interest in Canada in personally importing cars from the US. A few years ago the situation was reversed and a lot of cars both new and used were imported into the US either personally or by dealers.

    My question is this: A number of these cars must now be being traded in by their owners, do the dealers here take the fact that a car is a grey market car into account when valuing such a car or does it make no real difference?

    Now back to the topic of this discussion:

    Yes they are, but four or five years ago they looked very cheap to US buyers because of the exchange rate at that time and so a lot of cars, both new and previously cherished, were bought by US buyers. So now those cars are 4 or 5 years old and the time has come for their owners to be replacing them so I wondered how those cars are faring on the secondhand market.

    I like to think Bellicheck learns from his mistakes, having top notch players does help. But with a salary cap he has been able to get the right guys and there is something to be said about that.

    A reputable dealer or a bank will not touch a grey market car.

    But with Master Mind Bil Bellicheck at the wheel i feel the Pats will go undefeated this year.

    I posted this response in another forum:

    We went through the same thing with my father-in law's car in March, 2006. He passed away 2 1/2 months after leasing a Buick for 39 months. I spoke to GMAC numerous times and they were not sympathetic at all. The dealership sales manager had no idea what to do. I had gotten advice from someone on these boards to turn in the car to GM (they are obligated to take it). Then we spoke to an attorney and he advised us to take my father-in-laws name off everything possible to make the estate as small as we could.

    I later spoke to the management of the dealer and they tried to be helpful. They remembered my father-in-law and made inquiries about how much it would cost them to purchase the car from GMAC. They found out it would not be financially beneficial for them to purchase the vehicle but they went out of their way to help wherever they could. They even sent someone to pick up the car since my mother-in law does not drive and I am not in Florida. We returned the car to the dealer in May of 2006 and in July, received a bill from GMAC ($7800) for the difference of what we owed and what they got at auction. On the advice of the attorney, we ignored the bill. It is now 14 months later and have not heard from GMAC again.

    I don't know if they just wrote it off or what, but there has been no contact. I don't know if this is any help, but this was our experience.
