I helped a friend buy a Lexus ES350 in MA. The price negotiation was smooth. We put down a deposit and when we came to take delivery of the car, a business manager met with us and went over some options. He sold us a product which he positioned as an OEM from Lexus, e.g. Lexus part, Lexus has set the pricing on it and controls the warranty and we can get it serviced at any dealership and that 95% of his customers buy it.

We agreed and paid the extra cost, however, when my friend drove the car home, he found that the product was an aftermarket part and Lexus has no relationship to it and the warranty is controlled by third party company and not by Lexus. He was very upset because, he agreed to pay a premium believing it to be an OEM and now we think we have been totally scammed by the dealership.

Is this even legal, is there any recourse that we can adopt? Any help would be greatly appreciated.

What, specifically, other than the ES350, are you referring to?

It was referred to as the "Lexus Gel coat" by the manager. This came with exterior and interior coating and lifetime warranty. We learned later that Lexus doesn't offer anything like this but it is from Simonize.

Yeah - sorry, I’m not familiar with that but sounds like an extra that particular dealer adds to their vehicles to pad their profit. I adhere to a policy of not buying or paying for any extras I don’t want with a vehicle. At this point, maybe a meeting with the dealer’s General Manager might help.

Agreed. Not sure if the product can be removed at this point; if it can, you will likely have to rework the entire contract to have that cost removed and adjust the payment.

Thank you gmanusmc and Michaell for your comments. We feel completely ripped off because my friend paid $1150 for the gel coat ( exterior), interior treatment + Lifetime warranty believing it was all covered for by Lexus. Apparently not.

The gel coat and interior treatment cannot be removed, can we perhaps ask them to charge a nominal fee ( internet says < $200) and return the rest cancelling the warranty contract.

Keep us posted on how talks progress with the dealer. Lexus is known for great customer service; be interesting to see what they're willing to do to keep your friend happy.

We don't have the Eastern region MF or incentives, but we see .00001 and either $3200 or $3250 in incentives in other regions.

No specific purchase incentives, other than supported finance rates (again, those vary by region).
