Can manufacturer to dealer incentives sales tax be passed on to customers in Illinois? For example, the 2021 RDX currently has a $1,000 manufacturer to dealer incentive (Jan 5-Mar 1). Dealer is trying to pass along the sales tax of this incentive to me. Is this legitimate?

Found the taxing law regarding rebates and incentives on IL website that was amended in 2015, in response to particular vagueness in previous statute unlike the rest of the states (https://www2.illinois.gov/rev/research/legalinformation/regs/Documents/part130/130-2125.pdf). I believe this particular Acura incentive is covered by (f) in page 3, and specifically under example 1 or possibly example 4. Either case, the law states whether the dealer has to pay taxes on it. But the question is, can the dealer pass that sales tax on to the customer? I have bought a few cars in the past with manufacturer to dealer incentives without sales tax being passed, but the last vehicle I bought was in 2012 prior to amendment.

In general, dealer incentives are not subject to tax, nor have I ever heard in over 7 years answering lease questions, of a dealer attempting to pass along the tax on that incentive to the customer.

Have you checked with multiple dealers, and gotten the same response from all of them?

I don't see a $1000 Acura to dealer incentive on the RDX, this month.

There is a $1000 conquest incentive, but that is Acura to consumer, and would be taxed.

If you are being taxed, it isn't an Acura to dealer incentive.

No, I have not checked with other Acura dealers yet. It may be an Illinois thing? I hope not. LOL

Yeah, I totally understand that just because it's listed on an auto purchase website doesn't make it real, hence the disclaimer to check with dealer. Perhaps when they hear me ask about it, they were thinking about flex cash, but didn't quite articulate things well? Regardless, if a deal is put together, I'm going to have to verify the details with the finance guy before I sign.

I've often checked Costco information (when I was a member). None of it is very clear, and their "deals" vary greatly, depending on which manufacturer it is. Some of them aren't really deals at all, but just the incentives that anyone could get.

Factory to dealer incentives only serve to lower the selling price, and are not taxable. Anything listed as an incentive on the contract will be taxable (in almost every case)
